2017-1419 RESOLUTION NO. 2017-1419 A resolution declaring as surplus property 209 S. Water Street and authorizing the City Administration to proceed with the sale of the property. WHEREAS, the City of Janesville owns the following described parcel: Part of Lots 1 and 2, Block 47 of the Original Plat of the Village of Janesville, now City of Janesville, County of Rock, State of Wisconsin, described as follows: Commencing at an iron stake at the northwesterly corner of Lot 1 in said Block 47 of said Plat; thence running in a southerly direction along the westerly line of said Lots 1 and 2, (said line fronting on Water Street) a distance of 129.70 feet to an iron stake in the westerly line of said Lot 2 for the place of beginning; thence running easterly on a line parallel with the southerly line of said Lot 1 a distance of 57 feet; thence running northerly on a line parallel with the westerly line of said Lots 1 and 2, a distance of 62 feet; thence running westerly parallel with the southerly line of said Lot 1, a distance of 57 feet; thence running southerly along the westerly line of said Lots 1 and 2, a distance of 62 feet to an iron stake marking the place of beginning. EXCEPTING and reserving a perpetual right of way for ingress and egress in common with the grantees herein, over and upon a part of the above described land, described as follows: Commencing at the iron stake above described as the place of beginning and located in the westerly line of said Lot 2 a distance of 129.70 feet from the northwesterly corner stake of said Lot 1; thence running northerly to a point on the westerly line of said Lots 1 and 2 a distance of 49 feet for the place of beginning; thence running on a line parallel with the southerly line of said Lot 1 and in an easterly direction a distance of 36 feet; thence running northerly and on a line parallel with the westerly line of said Lots 1 and 2 a distance of 13 feet; thence running easterly and on a line parallel with the southerly line of said Lot 1 a distance of 21 feet; thence running southerly on a line parallel with the westerly line of said Lots 1 and 2 a distance of 42 feet; thence running westerly and on a line parallel with the southerly line of said Lot 1 a distance of 18 feet; thence running on an angle on a straight line to a point which would be at the intersection of two lines, one line being parallel to the westerly line of said Lots 1 and 2 a distance of 36 feet therefrom, and the other line being parallel to the southerly line of the land first above described being conveyed hereby and a distance of 41 feet therefrom; thence running westerly on such line which is parallel to the southerly line of the land conveyed herein and a distance of 41 feet therefrom, a distance of 36 feet to a point on the westerly line of said Lots 1 and 2; thence northerly on said westerly line of Lots 1 and 2 a distance of eight feet to the place of beginning. Located in the city of Janesville, Rock County, Wisconsin; and WHEREAS, the property is approximately 0.08 acres of land located at 209 S Water St and was purchased for general blight elimination of the overall redevelopment of Tax Increment District 17; and WHEREAS, the property is zoned B6 and is not necessary for City purposes and has been determined to be surplus property appropriate for sale; and WHEREAS, the Plan Commission has reviewed this request at its meeting held on April 17, 2017 and found the sale consistent with City plans and recommended that the City Council proceed with the sale of this property, but further noted that the Plan Commission has not reviewed the financial aspects of this transaction; and WHEREAS, the Common Council of the City of Janesville does hereby find that this property is surplus and is no longer needed for City purposes and that the proposed transaction is to the benefit and the best interest of the citizens and the City of Janesville. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville that it hereby authorizes and directs the City Manager and the City Clerk to negotiate, enter into and execute, on behalf of the City of Janesville, the sale of such property and to negotiate and execute such documents, papers and forms as may from time to time be necessary and/or desirable to effectuate such transaction and the intent of this resolution as the City Manager may decide; and BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take whatever other actions or to make whatever other minor changes that may be necessary to effectuate this land transaction.
