2017-1420 RESOLUTION NO. 2017- 1420 A RESOLUTION authorizing a five (5) year deferment of the requirement to connect to public sanitary sewer and water services. WHEREAS, the City of Janesville (the "Municipality") owns and operates the public sanitary sewer and water services for the residents of the City, and, WHEREAS, the property owner of 3138 US Hwy 51 South Janesville, WI. signed an Attachment Agreement that was recorded on Sept. 17, 2004 indicating that by signing this attachment agreement, the owner shall consent and agree to connect to the City's utilities within one year from the recording date of that agreement. Public sewer and water utilities are available, but the City never enforced this requirement to connect, and, WHEREAS, the mentioned property was officially attached to the City effective January 1, 2017, and, WHEREAS, the Municipality, upon annexation requires that properties with private sewer and water services to connect to the public services within one year after the annexation, and, WHEREAS, public water and sewer are available, and, WHEREAS, City of Janesville code of General Ordinance No. 13.12.040 offers the opportunity for the owner to seek a deferment of this utility connection requirement for up to five (5) years with the approval of the City Council, and, WHEREAS, the property owner of 3138 US Hwy 51 South Janesville, WI. will be required to enter into an agreement requiring the connection to the public sanitary sewer and water utilities within five (5) years after the signing of the agreement. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the City of Janesville that the property located at 3138 US Hwy 51 South. Janesville, WI be granted a five (5) year deferment from connecting to both public water and sanitary sewer systems upon signing of the agreement. If either the private water service or on- site septic systems fails or requires repairs before the five (5) year timeframe, connection to both public water and sewer utilities must occur.
