2017-1402 RESOLUTION NO. 2017-1402 A Resolution Authorizing an Amendment to an existing Ingress and Egress Access Easement on City-Owned Property at Marquette Park for S&K Dean Enterprises LLC. WHEREAS, the City of Janesville, Rock County, Wisconsin is the owner of certain real property known as "Marquette Park" located in Block 15 and 16 of Overlook Heights Addition No. 2, a recorded subdivision in the Southwest Quarter (SW 1/4) of Section 1, T.2N., R.12E., of the 4th P.M.; City of Janesville, Rock County, Wisconsin; and WHEREAS, the Janesville Planning Services Division, Engineering Division, Parks Division, and Public Works Department find that the proposed amendment does not conflict with the current or planned future use of City-owned land in the easement area; and WHEREAS, the proposed amendment would require that the general public shall have the right to use the easement area for parking purposes in connection with their use of Marquette Park; and WHEREAS, the Janesville Plan Commission, pursuant to Section 62.23, Wisconsin Statutes, reviewed the proposed amendment and found it to be consistent with City plans but did not review the financial aspects of the transaction; and WHEREAS, providing the amendment to an existing access easement is in the best interest of the City and its residents; and NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby grants the following described easement located in part of Block 16 of Overlook Heights Addition No. 2, a recorded subdivision in the Southwest Quarter (SW 1/4) of Section 1, T.2N., R.12E., of the 4th P.M., City of Janesville, Rock County, Wisconsin to S&K Dean Enterprises LLC, a Wisconsin limited liability company, as described as follows: The east 50 feet of the west 138 feet of Block 16 Overlook Heights Addition No. 2, a recorded subdivision in the Southwest Quarter (SW 1/4) of Section 1, T.2N., R.12E., of the 4th P.M., City of Janesville, Rock County, Wisconsin. BE IT FURTHER RESOLVED that the parking improvements permitted by this amendment shall be restricted to an area measuring 45 feet by 20 feet within the easement described herein; AND BE IT FURTHER RESOLVED that the City Manager and City Clerk of the City of Janesville are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of Janesville, a proposed easement between the City and Steven Dean, prepare and file such other documents, forms and papers pertaining to this transaction as may, from time to time, be necessary or desirable to effectuate the intent of this resolution and/or easements.
