2016-663 FILE ORDINANCE NO. 2016 -663 An ordinance amending the Fee Schedule and the Temporary Sanitation Fund Surcharge sections of the City's Solid Waste and Recycling Ordinance. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 8.64.150 (A) of the Code of General Ordinances of the City of Janesville is hereby amended to read: 8.64.150 FEE SCHEDULE A. For all wastes hauled to the Sanitary Landfill in vehicles other than City of Janesville owned vehicles, excluding special wastes and wastes used as daily cover, the fee charged shall be the greater of: Thirty five dollars and 00 /100 ccnts (35.00) Thirty six dollars and 00 /100 cents ($36.00) per ton, or SECTION II. Section 8.64.540 (C)(3) of the Code of General Ordinances of the City of Janesville is hereby repealed and replaced accordingly. 8.64.540 (C)(3) TEMPORARY SANITATION FUND SURCHARGE. 1. A Temporary Sanitation Fund Surcharge shall be established with the objective of recovering up to six million six hundred thirty five thousand nine hundred ninety five and 00 /100 ($6,635,995.00). a. The amount of six million six hundred thirty five thousand nine hundred ninety five and 00 /100 ($6,635,995.00) shall not be exceeded. b. The Common Council, through authorizing resolution or adoption of the annual City budget, shall establish the annual surcharge amount to be recovered. 2. The Common Council shall maintain a minimum Sanitation Fund balance of 16.7% of Sanitation Fund operating expenses. a. The Common Council, through authorizing resolution or adoption of the annual City budget, may authorize utilization of Sanitation Fund balance in excess of the required minimum balance for sanitary landfill capital projects and/or to draw down sanitary landfill debt. 3. The Common Council, by majority vote, may declare a fiscal emergency and withdraw any amount of the Sanitation Fund balance for purposes of addressing the fiscal emergency, provided the emergency is related to activities within the Sanitation Fund. Any such action must also provide for necessary appropriations to restore the Sanitation Fund balance to the required minimum balance within - three -year period. SECTION III. This Ordinance shall take effect upon adoption by the Common Council, the public health, welfare, safety, peace, good order, and public welfare of the City so requiring.
