2016-656 REVISED ORDINANCE NO. 2016 -656
An ordinance attaching territory in Sections 14 and 24 in T.2N., R.12E. of the 4th
P.M., Town of Rock, Rock County, Wisconsin.
WHEREAS, the owners of the land within such territory proposed to be attached have
executed and recorded attachment agreements that set forth the timeframe,
circumstances and conditions upon which attachment of property to the City of
Janesville shall occur within the City of Janesville/Town of Rock Cooperative Boundary
Plan area; and
WHEREAS, the City of Janesville/Town of Rock Cooperative Boundary Plan, as
amended, specifies that all non - residential properties with Attachment Agreements that
were signed and recorded on or before May 16, 2016 that are contiguous to the City or
are made contiguous to the City by other consenting properties shall be attached to the
City on December 31, 2016; and
WHEREAS, attachment of property to the City of Janesville follows an alternative form of
annexation, as provided in Section 66.0307 of the Wisconsin State Statutes, under
Cooperative Boundary Plans; and
WHEREAS, the necessary notices have been duly prepared, provided and served as
required by law to all persons affected; and
WHEREAS, this ordinance does not contain temporary zoning; and
WHEREAS, the Department of Administration has not found the proposed attachment to
be against the public interest; and
WHEREAS, the Common Council has determined that this attachment is in the public
interest.
NOW THEREFORE THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO
ORDAIN AS FOLLOWS:
The territory described as follows in Sections II. through VI. are hereby attached to the
City of Janesville.
SECTION II. Part of N 1 /2 of the SE 1 /4 of Section 14, T.2N., R.12E. of the 4th PM Town
of Rock, Rock County, Wisconsin, described as follows:
Commencing at a DOT Disk at the East 1 /4 corner of said Section 14, thence

SECTION VII. The attachment of the above described property will become effective on
December 31, 2016. Upon that date the above described property shall be exempt from
and not subject to further taxation and assessments in the Town of Rock and thence
forth shall be subject to taxation and assessment as part of the City of Janesville for any
and all purpose provided by law.
SECTION VIII. The territory described as follows is hereby attached to the City of
Janesville.
Part of N 1 /2 of the SE %4 of Section 14, T.2N., R.12E. of the 4th PM Town of Rock, Rock
County, Wisconsin, described as follows:
Commencing at a DOT Disk at the East 1 /4 corner of said Section 14, thence
S.42 °12'52 "W 492.52 feet to the Point of Beginning; thence N.89 °39'46 "W 314.00 feet;
thence N.00 °08'34 "W 35.40 feet; thence N.89 °24'20 "W 259.81 feet; thence
S.00 °11'34 "E 195.93 feet; thence S.89 °36'38 "E 223.31 feet; thence N.00 °57'08 "E 34.49

SECTION IX. The territory described as follows is hereby attached to the City of
Janesville.
The North 100 feet of the following described property: the East 330 feet of the North 1/2
of the SE 1/4 of Section 14, in Township 2 North of Range 12 East, Township of Rock,
County of Rock, State of Wisconsin, Excepting therefrom the North 528 feet thereof.
Said East 330 feet includes to the center of U.S. Highway No. 51.
Further Excepting land conveyed to the State of Wisconsin, Department of
Transportation in Deed recorded June 5,1991 as Document No. 1134417.
SECTION X. The territory described as follows is hereby attached to the City of
Janesville.
A 35 foot strip, previously used as a service drive, lying immediately South and adjacent
to the following: Part of the NE 1/4 of the SE 1/4 of Section 14, T.2N., R.12E., of the 4th
P.M., Township of Rock, County of Rock, State of Wisconsin described as follows:
Commencing at the intersection of the East and West centerline of said Section 14 with
the Westerly R.O.W. line of U.S.H. No. 51; thence S. 0 °03' W. along said Westerly
R.O.W. line 364.0 feet to the place of beginning for the land to be herein described;
thence continuing S. 0 °03' W. along said ROW line, 129.00 feet; then N. 89 °37" W.
280.0 feet; thence N. 0 °03' E, parallel to said R.O.W. line, 129.00 feet; thence S.
89 °28'20" E. 280.0 feet to the place of beginning. Excepting land conveyed by Warranty
Deed from Richard D. Helgesen, a single person to the State of Wisconsin, Department
of Transportation, dated April 24, 1991 and recorded on June 12, 1991 on Card 482,
Images 794 to 796, as Document No. 1135065.

SECTION XI. The attachment of the above described property will become effective
immediately upon adoption by the Common Council. Upon that date the above
described property shall be exempt from and not subject to further taxation and
assessments in the Town of Rock and thence forth shall be subject to taxation and
assessment as part of the City of Janesville for any and all purpose provided by law.
SECTION XII. All the territory attached by this ordinance is hereby made part of Ward
10 of the City of Janesville.
SECTION XIII. There are no residents in the area proposed for attachment.
SECTION XIV. The attachment is within the Janesville School District.
SECTION XV. This ordinance shall take effect immediately upon adoption by the
Common Council, the public health, welfare, peace, tranquility, good order, public
benefit, and police power so requiring.
