2016-1330 RESOLUTION NO. 2016 -1330
A resolution authorizing the conveyance of City land to the County of Rock to
accommodate the County Trunk Highway F Construction Project and Alliant Energy
electrical service upgrades.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of the parcel of real
property located in Section 13, R.12E., T.3N. of the 4 P.M., Rock County, Wisconsin described
as follows:
The east seven (7) feet of Grantor's land lying immediately to the west of, adjacent to, the west
right of way of County Highway F. Grantor's deed being recorded on February 24, 1983, on Card
Number 127, Image Number 618 -680, as Document Number 964082, in the office of the Register
of Deeds for Rock County, Wisconsin.
WHEREAS, the County of Rock finds, in order to accommodate the County Trunk Highway F
Construction Project; the portion of land owned by the City of Janesville is needed for road
purposes; and
WHEREAS, Alliant Energy finds, in order to accommodate upgrades to electric service to the Fire
Training Center; the portion of land owned by the City of Janesville is needed for utility service
purposes; and
WHEREAS, Wis. Stats. §§ 62.22 (1), 62.23 (17) (a), 62.23 (17) (b), 66.0101, 62.11(5) and
Chapter 32 and other pertinent Wisconsin Statutes permit the City of Janesville to find City land
surplus and to sell, lease, and /or otherwise convey said land; and
WHEREAS, the Common Council hereby find and declare these particular parcels of City owned
real property surplus and no longer necessary for City uses or purposes; and
WHEREAS, the City is transferring its interest in seven (7) feet of land to the County of Rock for
right -of -way for County Trunk Highway F as part of this conveyance; and
WHEREAS, the Common Council hereby find this conveyance to the County of Rock of benefit to
and in the interests of the City and its residents, businesses, and taxpayers; and
WHEREAS, on June 6, 2016, the Janesville Plan Commission reviewed the conveyance of
existing right -of -way to the County of Rock and found it to be consistent with City plans, but did
not review the financial aspects of this transaction; and
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that
they hereby approve and authorize the City Manager and /or his designee(s), on behalf of the City
of Janesville, to convey, and to close upon, the City's conveyance in quick claim deed of the
above described real property to the County of Rock to accommodate the County Trunk Highway
F Construction Project and Alliant Energy electrical service upgrades; and
BE IT FURTHER RESOLVED that the City Manager and /or his designee(s) may, from time to
time, negotiate, draft, amend, execute and enter into such contracts, documents, agreements and
amendments, and to take such other actions as the City Manager and /or his designees may
deem from time to time necessary or desirable to effectuate the intent of this resolution.
