A Resolution Authorizing the Transfer of Land to the Wisconsin Department of
Transportation on the South Side of the City to Accommodate the Widening
of Highway 11.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of real property
located on the south side of the City along Highway 11, legally described as follows:
Part of the Northeast ¼ of Section 13, T2N, R12E, and the Northwest ¼ of Section 18,T2N,
R13E, located within the City of Janesville, Rock County, Wisconsin.
WHEREAS, the Common Council of the City of Janesville recognizes the need to improve
State Trunk Highway 11 from U.S. Highway 51 (Center Avenue) to Interstate 39/90, a distance of 2.5
miles for increasing vehicular traffic, to eliminate deteriorating conditions and high maintenance costs,
and to improve traffic safety; and
WHEREAS, the Wisconsin Department of Transportation finds, in order to accommodate the
widening of Highway 11, that a portion of land owned by the City is needed for road purposes; and
WHEREAS, the Wisconsin Department of Transportation in consideration of said land
transfer, has agreed to provide compensation to the City of Janesville in the amount of $612,100; and
WHEREAS, on February 16, 2004, the Janesville Plan Commission reviewed the transfer of
land to the Wisconsin Department of Transportation and found it to be consistent with City plans, but
did not review the financial aspects of this transacation.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville
that the City Manager be authorized to convey the above described property to the Wisconsin
Department of Transportation for the widening and reconstruction of said Highway 11; and
BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the
City of Janesville, is/are hereby authorized and empowered to negotiate, draft, modify, review,
execute, and enter into additional agreements, payments, and record, file, and/or make minor
modifications and/or amendments to any and all documents, papers, forms, and agreements, and to
take whatever other actions as the City Manager may determine from time to time and at any time,
necessary and/or desirable to effectuate the intent of this Resolution.
