A Resolution Authorizing the Dedication of Land for the Widening and Reconstruction
of Beloit Avenue.
WHEREAS, the City of Janesville, Rock County, Wisconsin is the owner of real
property located on the south side of the City along Beloit Avenue, legally described as
follows:
Part of the Southeast ¼ of the Northeast ¼ and Northeast ¼ of the Northeast ¼
of Section 13, T2N, R12E, also part of the Southeast ¼ of the Southeast ¼
of Section 12, T2N, R12E, and also part of the Southwest ¼ of the Northwest
¼ and the Northwest ¼ of the Northwest ¼ of Section 18, T2N, RI 3E,
in the City of Janesville, Rock County, Wisconsin.
WHEREAS, the Common Council of the City of Janesville recognizes the need to
widen Beloit Avenue from State Trunk Highway 11 (Avalon Road) to Kellogg Avenue as part
of the selected route for the Janesville Transportation Improvements Project; and
WHEREAS, the Common Council previously approved this transportation project by
Resolution No. 2001-171; and
WHEREAS, the Common Council finds the widening of Beloit Avenue requires
additional right-of-way, a temporary interest to grade slopes, and a permanent limited easement
for a storm sewer; and
WHEREAS, the City of Janesville is an abutting property owner and may designate the
additional right-of-way and easements as necessary; and
WHEREAS, the properties required for this transportation project were reviewed by
the Janesville Plan Commission on October 15, 2001 and were found to be consistent with City
Plans.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Janesville that it does hereby designate 1.69 acres of land for permanent highway right-of-way,
0.51 acres of land as a temporary interest for slope grading, and 0.02 acres of land as a
permanent limited easement for a storm sewer, as described above, for widening and
reconstruction of Beloit Avenue; and
BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf
of the City of Janesville, is/are hereby authorized and empowered to negotiate, draft, modify,
review, execute, and enter into additional agreements, payments, and record, file, and/or make
minor modifications and/or amendments to any and all documents, papers, forms, and
agreements, and to take whatever other actions as the City Manager may determine from time
to time and at any time, necessary and/or desirable to effectuate the intent of this Resolution.
