2016-1319 RESOLUTION NO. 2016 -1319 A resolution authorizing the sale and conveyance of City land to the Wisconsin Department of Transportation (WisDOT) to accommodate the 1 -39/90 Expansion Project. WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of three parcels of real property located on the north side of City and legally described as follows: Parcel A: Parcel 28 of Transportation Project Plat 1005 -10 -25 -4.08, recorded as Document No. 2029003, in Rock County, Wisconsin. Parcel B: Parcel 32 of Transportation Project Plat 1005 -10 -25 -4.08, recorded as Document No. 2029003, in Rock County, Wisconsin; and Parcel 32 of Transportation Project Plat 1005 -10 -25 -4.09, recorded as Document No. 2029004, in Rock County, Wisconsin. Parcel C: Fee title in and to following tract of land in Rock County, Wisconsin, described as all that part of the Northeast 1 /4 of the Southwest 1 /4, the Southeast % of the Northwest % and the Southwest % of the Northwest 1/4 of Section 17, T3N, R13E, City of Janesville lying within the following described traverse: Commencing at a chiseled "X" at the south quarter corner of Said Section 17, City of Janesville, Rock County, Wisconsin; thence N00 ° 50'43 "W. 1499.15 feet; thence N68 ° 11'13 "W, 169.46 feet; thence N39 ° 49'58 "W 165.51 feet; thence N29 ° 31'43 "W 119.53 feet; thence N24 ° 29'47 "W 383.11 feet to the point of beginning; thence N65 ° 05'57" W 101.98 feet; thence northwesterly 1438.94 feet along the arc of a curve concave to the south, having a radius of 4780.02 feet (the long chord of which bears N37 ° 53'23" W 1433.51 feet); thence N45 ° 16'30 "W 79.28 feet; thence northwesterly 182.41 feet along the arc of a curve concave to the north, having a radius of 691.07 feet (the long chord of which bears N40 ° 14'24 "W 181.88 feet); thence northwesterly 233.38 feet along the arc of a curve concave to the north, having a radius of 335.00 feet (the long chord of which bears N11 ° 28'45 "W, 228.69 feet); thence N08 ° 30'08 "E, 21.84 feet; thence southeasterly 274.02 feet along the arc of a curve concave to the north, having a radius of 388.79 feet (the long chord of which bears S22 ° 23'55 "E 268.39 feet); thence S42 ° 35'24 "E 153.72 feet; thence S39 ° 46'52 "E 108.60 feet; thence S44 ° 12'37 "E 160.76 feet; thence southeasterly 1228.37 feet along the arc of a curve concave to the south, having a radius of 4718.62 feet (the long chord of which bears S36 ° 45'09 "E 1224.91 feet); thence S42 ° 58'29 "E 100.00 feet to the point of beginning. This contains 1.685 acres, more or less, lying within the right -of -way of Deerfield Drive. WHEREAS, the Wisconsin Department of Transportation finds, in order to accommodate the accommodate the Interstate Highway 39/90 Corridor Expansion Project; those portions of land owned by the City of Janesville is needed for road purposes; and WHEREAS, Wis. Stats. §§ 62.22 (1), 62.23 (17) (a), 62.23 (17) (b), 66.0101, 62.11(5) and Chapter 32 and other pertinent Wisconsin Statutes permit the City of Janesville to find City land surplus and to sell, lease, and /or otherwise convey said land; and WHEREAS, the Common Council hereby find and declare these particular parcels of City -owned real property surplus and no longer necessary for City uses or purposes; and WHEREAS, the City is transferring its interest in 1.685 acres of existing right -of -way for Deerfield Drive to the Wisconsin Department of Transportation as part of this conveyance; and WHEREAS, the Common Council hereby find this sale and conveyance to the Wisconsin Department of Transportation of benefit to and in the interests of the City and its residents, businesses, and taxpayers; and RESOLUTION NO. 2016 -1319 PAGE 2 WHEREAS, on May 16, 2015, the Janesville Plan Commission reviewed the sale of land and conveyance of existing right -of -way to the Wisconsin Department of Transportation and found it to be consistent with City plans, but did not review the financial aspects of this transaction; and WHEREAS, the Wisconsin Department of Transportation has offered to purchase Parcel A containing 0.533 acres of land from the City of Janesville for the sum of Forty -Four Thousand Two - Hundred and 00/100 Dollars ($44,200.00) and Parcel B containing 0.319 acres of land for the sum of Twenty -Six Thousand Five Hundred and 00/100 Dollars; and NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that they hereby approve and authorize the City Manager and /or his designee(s), on behalf of the City of Janesville, to sell and convey, and to close upon, the City's sale and conveyance in fee simple of the above described real property to Wisconsin Department of Transportation to accommodate the 1- 39/90 Expansion Project; and BE IT FURTHER RESOLVED that the City Manager and /or his designee(s) may, from time to time, negotiate, draft, amend, execute and enter into such contracts, documents, agreements and amendments, and to take such other actions as the City Manager and /or his designees may deem from time to time necessary or desirable to effectuate the intent of this resolution.
