2016-1300 RESOLUTION NO. 2016 -1300 A proposed resolution to support a grant request to the Wisconsin Department of Natural Resources for funding through the 2016 Stewardship - Urban Rivers Program. WHEREAS, the City of Janesville adopted the ARISE: The Rock Renaissance Redevelopment and Implementation Strategy (ARISE Plan) in February 2015; and WHEREAS, the ARISE Plan had an extensive amount of public participation over a two -year planning process; and WHEREAS, the ARISE Plan calls for the development of a Town Square — a dynamic public space centered on the Rock River — in the area currently occupied by the downtown parking plaza; a 200+ ARISE parking structure over the Rock River that is rapidly deteriorating; and WHEREAS, the ARISE Plan listed the removal of the parking plaza and construction of the Town Square as the top implementation priorities; and WHEREAS, the City plans to include several improvements in the Town Square Phase I project that would greatly increase public access to the Rock River and improve water quality; and WHEREAS, the City will utilize General Obligation bonds from a future Note Issue as identified in the Capital Budget and potentially apply other grant funding to pay for removal of the Parking Plaza and initial Town Square Improvements; and WHEREAS, the State of Wisconsin Department of Natural Resources (DNR) is currently soliciting grant applications for assistance in constructing improvements that provide additional recreation opportunities to area residents, improve the quality of public lands and waterways, and increase access to and use of public waterways; and WHEREAS, the State share for such a project may not exceed fifty percent (50 %) of the total eligible project costs under the Stewardship Grant Program, and up to a maximum amount of $45,000.00 of total eligible project costs under the Recreational Trail Aids (RTA) program; and WHEREAS, financial aid is required to carry out the Town Square Phase I improvements as described in detail in the DNR application. NOW, THEREFORE, IT IS HEREBY RESOLVED by the Common Council of the City of Janesville that: 1. All above introductions and recitals are incorporated herein by reference as if fully set forth verbatim; and 2. The City Manager is authorized and empowered by the City of Janesville to prepare and submit applications to the State of Wisconsin Department of Natural Resources for any financial aid that may be available; and 3. The City of Janesville shall take any and all necessary actions to undertake, direct, and complete approved grant activities and comply with federal and state rules for the programs including, but not limited to: appropriating, funding and /or providing all grant required city matching contributions; submitting reimbursement claims along with necessary supporting documentation within six months of project completion date; and submit signed documents as may be required by the DNR; BE IT FURTHER RESOLVED, that the City of Janesville shall comply with state or federal rules for the programs to the general public during reasonable hours consistent with the type of facility; and will obtain from the State of Wisconsin Department of Natural Resources or the National Park Service approval in writing before any change is made in the use of the project site. BE IT FURTHER RESOLVED, that the City manager and his designee(s), on behalf of the City of Janesville, is /are hereby jointly and severally authorized and empowered to negotiate, draft, review, revise, modify, amend, execute, enter into, file, and /or record additional applications, agreements, amendments, documents, reports, and letters of understanding concerning this matter, and to take whatever additional other actions that the City Manager may determine in his sole discretion, from time to time and at any time, necessary and /or desirable in the public interest to effectuate the intent of this Resolution and /or the public good.
