2003-439RESOLUTION NO. 2003-439 A resolution granting a perpetual easement for an off-premise sign on City property along Beloit Avenue to Arthur T. Donaldson. WHEREAS, the City of Janesville purchased property located at the northwest comer of Beloit Avenue and STH 351 from Arthur T. Donaldson in 2001; and WHEREAS, in the purchase agreement, the City granted Arthur T. Donaldson fights to maintain off-premise signs upon that City property including fights to relocate signs if necessary for road widening. WHEREAS, the STH 351 project at the intersection of Beloit Avenue and STH 351 will require the relocation of an off-premise sign on other City-owned property; and WHEREAS, on November 3, 2003, the Plan Commission approved the relocation of an off- premise sign to a new location on a City-owned property located on Beloit Avenue; and WHEREAS, in order to facilitate the relocation of this off-premise sign, granting of a perpetual easement to Arthur T. Donaldson, the owner of the existing sign easement, by the City Council for the sign at the new City location is necessary; and WHEREAS, the easement grants Arthur T. Donaldson similar rights he currently enjoys at the present location such as the perpetual right to construct, maintain and have access to a 12 by 50 foot back-to-back, double faced sign structure with a height of 30 feet on the new Beloit Avenue location; and WHEREAS, upon relocation of the existing off-premise sign from its current location along STH 351 west of Beloit Avenue, Arthur T. Donaldson will relinquish the current perpetual sign easement rights for that sign; and WHEREAS, the City Council finds the granting of the perpetual sign easement consistent with the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby grants perpetual easement fights to Arthur T. Donaldson at the following described location: Part of Lot 1 of CSM 1426440, recorded in Vol. 22, Pages 337, 338, 339, 340 and 341 of the Rock County Register of Deeds, located in the SW 1/4 of the NW 1/4 of Section 18, Town 2 North, Range 13 East, City of Janesville, Rock County, Wisconsin, described as follows: Commencing at the NW comer of said Lot 1; thence S00-05-50E, along the west line of said Lot 1, also being the east R/W line of Beloit Avenue, 325 ft. to the POINT OF BEGINNING; thence continuing S00-05-50E, 50.00 ft; thence N89-54-10E, 110.00 ft; thence N00-05-50W, 50.00 ft; thence S89-54-10W, 110.00 ft. to the POINT OF BEGINNING. Containing approximately 5500 Sq. Ft. (0.126 acres). RESOLUTION NO. 2003-439 Page 2 BE IT FURTHER RESOLVED that the City Manager and the City Clerk of the City of Janesville are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of Janesville, the proposed easement between the City and Arthur T. Donaldson, prepare and file such other documents, forms and papers pertaining to this transaction as may, from time to time, be necessary or desirable to effectuate the intent of this resolution and/or easements.
