2003-424RESOLUTION NO. 2003-424 A Resolution authorizing the City Manager to apply for a Wisconsin Safe Drinking Water Fund Loan WHEREAS, the City of Janesville Water Utility is in need of additional potable water pumping capacity to meet the future needs of the City; and WHEREAS, elevated nitrates exist in the groundwater that supplies the City; and WHEREAS the design and construction of a project to pump additional water are included in the 2003 and 2004 Water Utility Budgets as Capital Improvement Projects; and WHEREAS, these additional pumping facilities will reduce nitrates in the water supply to acceptable levels; and WHEREAS, the Common Council of the City of Janesville intends to fund the proposed Well and Pumping Station No. 14 project, which has an estimated construction cost of $2,700,000; and WHEREAS, the said cost ($2,700,000) will be eligible for a Wisconsin Department of Natural Resources (WDNR) Safe Drinking Water Fund Iow interest loan, which will be repaid by user fees; and WHEREAS. the WDNR has required that an authorized representative be designated by adopted resolution for a Safe Drinking Water Fund loan; and WHEREAS. Thomas O. Rogers, 18 N. Jackson Street, Janesville, Wisconsin 53545, (608) 755-3000, is the Assistant City Manager of the City of Janesville; NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of Janesville that the City Manager be authorized to apply to the Wisconsin Department of Natural Resources for a Safe Drinking Water Fund Iow interest loan and that itendorses Thomas O. Rogers as the authorized representative in any actions or for any requirements needed for a Safe Drinking Water Fund loan. BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the City of Janesville, is/are hereby jointly and severally authorized and empowered to negotiate, draft, review, revise, modify, amend, execute, enter into, file and/or record additional agreements, amendments, documents and letters of understanding concerning this matter, and to take whatever additional other actions that the City Manager may determine in his sole discretion, from time to time and at any time, necessary and/or desirable in the public interest to effectuate the intent of this Resolution. 18-19584.2 ADOPTED: December 8, 2003 APPROVED: Steven E.
