2016-1277 RESOLUTION NO. 2016 -1277
A resolution authorizing the City Manager to proceed with the conveyance of property located at
152 Linn Street to, and approving a Developer's Agreement with, Community Action, Inc. for the
development of one single - family home.
WHEREAS, the City of Janesville owns the following described parcel:
Lot 1, Block 5, Palmer & Sutterland's Addition, to the City of Janesville, Rock County, Wisconsin.
For informational purposes: 152 Linn Street, Janesville, WI 53548; Tax ID No. 241 - 0136400145.
WHEREAS, The City of Janesville acquired the properties located at 903 and 907 McKinley Streets in
2009 and 2010, respectively, with note issue funding provided for blight elimination purposes, with the
intention of demolishing the structures, combining the lots, and donating the property to a not - for - profit
organization for residential redevelopment purposes; and
WHEREAS, The City of Janesville has demolished the structures that were located on the site; and
WHEREAS, the Common Council approved CSM 16002 -C, which combined the lots into one single
development site with a remnant portion to be conveyed to the adjoining property owner at 158 Linn
Street at no additional cost to the property owner; and
WHEREAS, On December 17, 2015, Community Action, Inc. of Rock and Walworth Counties submitted a
proposal to the City for the new construction of a single family home and requesting the donation of 152
Linn Street and the provision of $23,750 in Tax Increment Finance funding to support the project; and
WHEREAS, Community Action, Inc. of Rock and Walworth Counties has prepared plans for the
construction of a new single family home under the HOME Investment Partnership Program; and
WHEREAS, the newly constructed home will be sold to an income eligible party under the HOME
Investment Partnership Program guidelines: and,
WHEREAS, Wisconsin Statutes, Section 66.1105, authorize cities to utilize tax increment financing for
affordable housing; and
WHEREAS, the Common Council of the City of Janesville created Tax Incremental Financing District No.
33, which includes $250,000 in the approved Project Plan for housing improvements within '/2 mile radius
of the District; and
WHEREAS, Community Action, Inc. of Rock and Walworth Counties have negotiated a Developer's
Agreement which calls for the City of Janesville to convey the property located at 152 Linn Street and
provide funding in the amount of Twenty -Three Thousand Seven Hundred and Fifty and 00/100 Dollars
($23,750) to Community Action, Inc. for the construction of a single family home at 152 Linn Street; and
WHEREAS, the Common Council of the City of Janesville hereby find that the approval of this negotiated
Development Agreement with Community Action, Inc. to be in the best interest and of benefit to the City
of Janesville, its citizens, residents, taxpayers and the overall community;
NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville that it
hereby authorizes and directs the City Manager and the City Clerk to execute on behalf of the City of
Janesville, the conveyance of such property; and to negotiate and execute such documents, papers and
forms as may from time to time be necessary and /or desirable to effectuate such transaction and the
intent of this resolution as the City Manager may decide; and
BE IT FURTHER RESOLVED, by the Common Council of the City of Janesville that the negotiated
Development Agreement with Community Action, Inc. are hereby approved and authorized, according to
the terms and conditions set forth in the specific Development Agreement; and
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to take whatever other actions
or to make whatever other minor changes that may be necessary to effectuate this land transaction.
