Minutes 11-10-03.docPROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING November 10, 2003 Approved: November 24, 2003 VOL. 54 NO. 20 Regular meeting of the Janesville City Council held in the Municipal Building on November 10, 2003. The meeting was called to order by Council President Williams at 7:00 p.m. Councilmember Wellnitz led the Council in the Pledge of Allegiance. Present: Council President Williams, Councilmembers Addie, Steeber, Brien, Murphy, DeGarmo and Wellnitz. CONSENT AGENDA Minutes of the special meeting of October 20, 2003. Minutes of the special meeting of October 22, 2003. Minutes of the regular meeting of October 27, 2003. Closed Session of October 27, 2003. Licenses; and Recommendations of the Alcohol License Advisory Committee. Waiver of special assessment procedure for sidewalk charges for CSM #03001, Learsi. Council President Williams stated that the Consent Agenda would be approved if there were no objections. There were none. OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. Ty Bollerud, 424 South Pearl Street, shared his suggestions for health care costs for City employees. Len Loertscher, President of JPPA, stated that the City should maintain 1.72 police officers per thousand people in the City. Alfred Lembrich, 541 Miller Avenue, stated employees deserve adequate staffing levels for police and fire. 2. A proposed resolution creating a Business Improvement District (BID) in Downtown Janesville and approving the BID 2004 Operating Plan was pulled from the agenda and no action was taken. (File Res. No. 2003-433) 3. A proposed ordinance creating a permanent Slow-No Wake Zone in the Rock River received its second reading and public hearing. The public hearing was opened. Ty Bollerud, 424 South Pearl Street, wondered why the State cut state shared revenue to the City but would fund $600,000 for a marina. Ronald Wyss, 1616 Winchester Place, representing the Aqua Jays, spoke in support of the ordinance. Norman Tadt, Jr., 1311 MacArthur Drive, and Curt Rankins, 4730 West Oakwood Park Drive, both spoke in opposition of the ordinance. Matthew Pyne, 2132 Ontario Drive, outlined the pros and cons of the ordinance. Alfred Lembrich, 541 Miller Avenue, stated the City Administration should have known the Department of Natural Resources would request a no-wake-zone. The public hearing was closed. Councilmember Steeber moved to deny said ordinance, seconded by Councilmember Murphy and passed unanimously. (File Res. No. 2003-177) 4. A proposed resolution vacating Sterling Drive received its public hearing. No one spoke. Councilmember Wellnitz moved to adopt said resolution, seconded by Councilmember Steeber and passed unanimously. (File Res. No. 2003-417) 5. A proposed ordinance rezoning property located at the northeast corner of Tripp and Hayner Roads from R3 to R1 received its second reading and public hearing. No one spoke. Councilmember Wellnitz moved to adopt said ordinance, seconded by Councilmember Brien and passed unanimously. (File Ord. No. 2003-182) 6. & 7. A proposed ordinance (2003-196) annexing property located east of Beloit Avenue and south of Conde Street and a proposed ordinance (2003-197) zoning said property to M2 upon annexation received their second reading and joint public hearing. No one spoke. Councilmember DeGarmo moved to adopt said ordinances, seconded by Councilmember Steeber and passed unanimously. (File Ord. Nos. 2003-196 & 2003-197) 8. A proposed ordinance rezoning property located within the 300-400 block of South Walnut Street from R3 and M1 to R2 received its second reading and public hearing. Council President Williams opened the public hearing and continued it until November 24, 2003. (File Ord. No. 2003-198) 9. & 10. A proposed ordinance (2003-199) annexing property located south and adjoining UW-Rock County property west of Garden Drive and a proposed ordinance (2003-200) zoning said property to R1 upon annexation received their second reading and joint public hearing. No one spoke. Councilmember DeGarmo moved to adopt said ordinances, seconded by Councilmember Steeber and passed unanimously. (File Ord. Nos. 2003-199 & 2003-200) 11. & 12. A proposed ordinance (2003-201) annexing property located at 3942 East Rotamer Road and a proposed ordinance (2003-202) zoning said property to R1 upon annexation received their second reading and joint public hearing. No one spoke. Councilmember Brien moved to adopt said ordinances, seconded by Councilmember Wellnitz and passed unanimously. (File Ord. Nos. 2003-201 and 2003-202) 13. Public hearing on the FY 2004 proposed City and Library Budgets. City Manager Sheiffer stated additions to the budget will include a new state fee for manufacturing assessments and a grant to fund one police officer. The public hearing was opened. Scott Morovits, 3450 Crabapple Lane, President of the Firefighters Union - Local 580, does not believe the Council has given the Administration enough resources to bargain faithfully. Scott Feldt, Vice President of Government Relations for Forward Janesville, commended the Council on fiscal restraint and suggested ad hoc committees to review utility rate increases, capital building projects and health insurance costs. NEW BUSINESS 1. Action on a proposed resolution authorizing the issuance of $2,600,000 in General Obligation Promissory Notes, Series 2003-A, and providing the details thereof. Councilmember Steeber moved to adopt said resolution, seconded by Councilmember Murphy and passed unanimously. (File Res. No. 2003- 427) 2. Action on a proposed resolution approving the acquisition of land on Plainfield Avenue west of Kennedy Road for a new well and reservoir. Councilmember Steeber moved to adopt said resolution, seconded by Councilmember DeGarmo and passed unanimously. (File Res. No. 2003-430) 3. Action on a request for a blasting permit from Barbarossa Blasting, Inc. Councilmember Murphy moved to approve said request, seconded by Councilmember Addie and passed unanimously. 4. Matters not on the Agenda. City Manager Sheiffer stated the 2004 tax rate will be set at a special City Council meeting on November 25, 2003, at 4:30 p.m. Council President Williams scheduled a study session on curfews and cafes on December 11, 2003, at 5:00 p.m. Council waived notice for the meetings. Councilmember DeGarmo requested material regarding cats running at large. Councilmember Addie requested the status of the mobile vending license ordinance and his request for a no turn on red at the intersection of Beloit Avenue and Delavan Drive. The Administration will provide the Council with a timeline for the ordinance and the no turn on red has been referred to the Transportation Committee with an Administrative recommendation of "no change." Also, Councilmember Addie requested information on what would be the cost of adding one police officer on an average residential tax bill. City Manager Sheiffer stated it would cost approximately $1.75. 5. Closed Session. Councilmember Steeber moved to convene into closed session pursuant to Wisconsin Statute Section 19.85(1)(e), for the purpose of considering collective bargaining strategies since competitive or bargaining reasons require a closed session, seconded by Councilmember Addie and passed unanimously.
