2003-430RESOLUTION NO. 2003-430 A resolution authorizing the City of Janesville to acquire property located on Plainfield Avenue west of Kennedy Road for a deep well and water reservoir. WHEREAS, in a routine sampling of the City's water supply, high nitrate levels were discovered in the Kennedy Road pumping station (Station No. 7); and WHEREAS, upon obtaining these results, the City retained a consulting engineering firm, Strand & Associates, Inc., to identify and evaluate alternatives to address the elevated nitrate levels; and WHEREAS, the consultant recommended that the City construct a deep well, blending reservoir and water boosting station near Station No. 7; and WHEREAS, the city identified several sites within a quarter-mile from Station No. 7 to construct the deep well/blending reservoir; and WHEREAS, the City of Janesville has negotiated an option to purchase a 1.6 acre property located in the 1300 block of Plainfield Avenue for a purchase price of $85,000 which property is legally described as follows: Beginning at the SE corner of CSM 984815 recorded in Volume 11, Pages 435 and 436 of Certified Survey Maps, Rock County, Wisconsin, thence N.18°00'00"W. 315.00 feet; thence S.57°24'57'~V. 288.76 feet; thence S.31°59'15"E. 265.00 feet to the SW corner of said CSM; thence along the arc of a 345.0 foot radius curve concave to the south (the long chord bears N64°02'55"E. 72.37 feet; thence N.70°04'10"E. 143.80 feet to the point of beginning. Containing 1.642 acres. WHEREAS, the Plan Commission reviewed the acquisition of this property at its 3 November 2003 meeting and found such property acquisition to be consistent with City plans but did not review the financial aspects of this transaction; and WHEREAS, the funding for this acquisition will be included in the 2003 Bond Issue; and WHEREAS, the Common Council of the City of Janesville does hereby find the acquisition of this property in the best interest of the citizens of the community and in the best interest of the City of Janesville. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVlLLE that its hereby approves and authorizes the City Manager to execute the City's option and hereby purchase the property located within the 1300 block of Plainfield Avenue. BE IT FURTHER RESOLVED, that the City Manager and his designees are hereby authorized to negotiate, draft, prepare, execute, file and modify such other documents, papers and agreements ancillary and/or pertaining thereto and, from time to time, to make whatever other minor modifications to the above-described agreement as the City RESOLUTION NO. 2003~,30 PAGE 2 Manager and/or his designees may deem necessary and/or desirable to effectuate the purposes of such acquisition, agreement and the intent of this resolution.
