2015-1251 RESOLUTION NO. 2015 -1251 A resolution authorizing the conveyance of easements for drainage purposes to the Wisconsin Department of Transportation (WisDOT) to accommodate the 1 -39/90 expansion project. WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of real property, designated as public greenbelt, located south of Ruger Avenue and north of Mt. Zion Avenue, portions of which are legally described as follows: Parcel 2: Parcel 2 of Transportation Project Plat No. 1005 -10 -24 -4.05, recorded as Document No. 2020400, in Rock County, Wisconsin. Parcel 21: Parcel 21 of Transportation Project Plat No. 1005 -10 -24 -4.10, recorded as Document No. 2020405, in Rock County, Wisconsin. WHEREAS, the Wisconsin Department of Transportation finds, in order to accommodate the reconstruction and expansion of 1- 39/90, that two portions of land owned by the City of Janesville are needed as permanent limited easements for drainage purposes; and WHEREAS, Wis. Stats. §§ 62.22 (1), 62.23 (17) (a), 62.23 (17) (b), 66.0101, 62.11(5) and Chapter 32 and other pertinent Wisconsin Statutes permit the City of Janesville to sell, lease, and /or otherwise convey said land for public purposes; and WHEREAS, the Public Works Department Staff have determined that the location of the drainage easements do not conflict with the current or planned future use of City -owned lands in the easement areas; and WHEREAS, the Common Council hereby finds conveyance of said drainage easements to WisDOT of benefit to and in the interests of the City and its residents, businesses, and taxpayers; and WHEREAS, on November 2, 2015, the Janesville Plan Commission reviewed the proposed conveyance of permanent limited easements to the Wisconsin Department of Transportation and found it to be consistent with City plans, but did not review the financial aspects of this transaction; and WHEREAS, the Wisconsin Department of Transportation has offered to acquire a permanent limited easement on Parcel 2 containing .737 acres of land for the sum of Eight Thousand Twenty Five and 00/100 ($8,025) Dollars; and to acquire the same on Parcel 21 containing 0.199 acres of land for the sum of Two Thousand Two Hundred ($2,200) Dollars. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville that they hereby approve and authorize the City Manager and /or his designee(s), on behalf of the City of Janesville, the conveyance of permanent limited easements on the above - described city -owned property to WisDOT to accommodate the 1 -39/90 expansion project; and RESOLUTION NO. 2015 -1251 PAGE 2 BE IT FURTHER RESOLVED that the City Manager and his designee(s) may, from time to time, negotiate, draft, amend, execute and enter into such contracts, documents, and agreements and take such other actions as the City Manager and /or his designees may deem necessary or desirable to effectuate the intent of this resolution.
