A resolution granting an easement to Alliant Energy across a portion of Waveland Park.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of property located in the
Southwest Quarter (SW 1/4) of the Northwest Quarter (NW 1/4) of Section 34 ofT.3N., R. 12E. in the 4th
P.M., City of Janesville, Rock County, Wisconsin;
WHEREAS, Alliant Energy Wisconsin finds that in order to better serve its customers and upgrade electric
utility services, it is necessary to obtain an easement to locate utility facilities on and across certain lands
owned by the City of Janesville; and
WHEREAS, the City Planning, Engineering, Leisure Services and Public Works staffhave determined that
the location of the proposed easement does not conflict with the current or planned future use of Waveland
Park in the easement area; and
WHEREAS, Alliant Energy has agreed to provide financial compensation to the City for the granting of the
easement in the amount of $1,000.00; and
WHEREAS, on 2 September 2003 the Janesville Plan Commission, pursuant to Section 62.23, Wisconsin
Statutes, reviewed the granting of this easement to Alliant Energy and found it to be consistent with City
plans but did not review the financial aspects of the transaction; and
WHEREAS, providing this easement is in the best interest of the City and its residents; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the City of Janesville hereby grants the easement located in Section 34 ofT.3N., R. 12E.
of the 4th P.M., City of Janesville, Rock County, Wisconsin, to Alliant Energy as described below:
An easement 10 feet in width and lying within 10 feet Northeaseterly of the following described reference
line:
Commencing at the southwest comer of Lot 65 of the Second Waveland Orchard Subdivision; thence North
79 degrees 05 minutes 15 seconds East, 129.97 feet along the south line of said Lot 65 to the point of
beginning; thence North 20 degrees 02 minutes 45 seconds West, 250.59 feet to a point in the Grantor's
north property line and there terminating.
Said easement to be located on a parcel of land as described and recorded on June 28, 1973 in Volume 480
of Records, pages 337 and 338, as Document Number 801645, in the office of the Register of Deeds for
Rock County, Wisconsin, and being located in part of the Southwest Quarter (SW ¼) of the Northwest
Quarter CNW ¼) of Section 34, Town 3 North, Range 12 East, City of Janesville, Rock County, Wisconsin.
BE IT FURTHER RESOLVED that the City Manager and City Clerk of the City of Janesville are hereby
authorized to negotiate, draft, enter into and execute, on behalf of the City of Janesville, a proposed easement
between the City and Alliant Energy, prepare and file such other documents, forms and papers pertaining to
this transaction as may, from time to time, be necessary or desirable to effectuate the intent of this resolution
and/or easement.
