2003-181ORDINANCE NO. 2003 - 181 An ordinance creating a specific exemption to the Wisconsin Open Records Laws by rendering income and expense method valuation and assessment data, information and records provided to the assessor confidential, in accord with Section 70.47(7)(ad~ of the Wisconsin Statutes, but public if used by the property owner/possessor publicly for any purpose including, but not limited to, at a board of review hearing. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Sections 2.58.060 C., D. and E of the Code of General Ordinances of the City of Janesville are hereby renumbered 2.58.060 D, E. and F, respectively. SECTION II: A new Section 2.58.060 C. of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "C. As provided by Section 70.47(7)(af) of the Wisconsin Statutes, as from time to time amended or renumbered, any and all income and expense data, information, forms and records pertaining to income method valuation and assessment of property provided by a property owner or possessor, or persons acting on his/her/their behalf to the City Assessor shall be kept confidential, except for persons using the information in the discharge of duties imposed by law or of the duties of their office or by order of a court. The information that is provided under this paragraph, unless a court determines that it is inaccurate, is not subject to the right of inspection and copying under s. 19.35 (1) or any other city ordinance notwithstanding. In the event that a property owner or his/her agent or representative makes the information public by appearance or use at a board of review hearing, or makes the information public at any other time or place, then such information shall cease to be confidential and shall be considered public, in which event the assessor and/or his/her staff, representatives and agents may use the information publicly for any purposes including, but not limited to, at the board of review hearing and related proceedings without prior notice to the property owner or possessor." SECTION III. This ordinance shall take effective immediately upon adoption, the public health, welfare, peace and good order so requiring. ADOPTED: July 14, 2003 APPROVED: t~e~ E.
