2015-602 ORDINANCE NO. 2015-602 An Ordinance permitting vehicles utilized for governmental functions to be operated off of the public roadway with penalties as set forth in newly created J.G.O. 10.60.070 and 12.60.460. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Chapter 10.60 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: CHAPTER 10.60 MOTOR - PROPELLED VEHICLE Section: 10.60.010 Regulations -- Generally. 10.60.020 Use - -Area allowed 10.60.030 Unlicensed vehicles - -Use prohibited when -- Exceptions. 10.60.040 Exceptions to Section 10.60.020 10.60.040 050 Exceptions to Section 10.60.030. 10.60.050 -060 Limitation of vehicles operating in certain areas. 10.60.060 -070 Violation -- Penalty. 10.60.010 Regulations — Generally In order to provide for the health, safety and general welfare of the citizens, and to regulate vehicles inherently dangerous to life and limb, and to further provide for abatement of noise pollution, the provisions of this chapter are enacted upon all public and private lands within the city. 10.60.020 Use - -Area allowed All motor driven or power driven vehicles, as defined by Section 340.01 (74) (33) and (35) of the Wisconsin Statutes, and which are licensable under the Vehicle Code of the state, may only be driven on public roadways dedicated for public travel, and to and from any place of parking on private property by the shortest distance to such public roadways. 10.60.030 Unlicensed vehicles - -Use prohibited when -- Exceptions A. All vehicles, as defined in Section 10.60.020, which are not licensable under the Vehicle Code of the state are expressly prohibited from being operatiftged the power or motor unit within the city, whether on public or private property, between nine p.m. and eight a.m., unless excepted by Sections 10.60.040, 10.60.050, or 10.60.0560. B. No person shall operate any such unlicensable powered vehicle on any land zoned R1 or R2 by this code at any time, except that a person may operate an ATV and other unlicensable meter powered vehicles upon land zoned R1 or R2 solely for the following purposes, and then only during such times as set forth in subsection (A) above: 1. To and/or from a garage, storage shed or similar structure upon property which is such person's principal residence or where such ATV or other unlicensable meter powered vehicle is customarily stored to load upon or unload from a truck or other vehicle for transport and use off site, but only by means of the shortest distance, and in no event longer than five (5) minutes at any one time nor more often than twice per day. 2. To haul a boat trailer for storage purposes upon property which is such person's principal residence or where such trailer is customarily stored, but only by means of the shortest distance, and in no event longer than five (5) minutes at any one time nor more often than twice per day. 3. To plow snow upon paved driveways or sidewalks. 10.60.040 Exceptions to Section 10.60.020 Excepted from Section 10.60.020 shall be any vehicles operated by employees of or incidental to the function of any federal, state or municipal governmental body or any subdivision thereof. 10.60.040 -.050 Exceptions to Section 10.60.030 Excepted from Section10.60.030 shall be motor vehicles as described in Sections 341.26(3) and (4) and 341.266 of the Wisconsin Statutes; powered lawn mowers, garden tractors, and agricultural equipment; golf carts and golf course maintenance equipment, when operated on golf courses; equipment being directly used in construction, removal, renovation or demolition of any property, or such equipment when in transit; any motor driven or power driven vehicles operated by employees of or incidental to the function of any federal, state or municipal governmental body or any subdivision thereof; and vehicles operated inside of buildings, power -driven equipment actually being used in manufacturing, processing or warehousing or such equipment when in transit. 10.60.0-50.060 Limitation of vehicles operating in certain areas Notwithstanding any provision of this chapter, all vehicles specifically allowed to operate in certain areas by Sections 12.60.230 through 12.60.310 of this code are permitted to operate within those limitations. 10.60.060 -.070 Violation — Penalty The penalty for violation of this chapter shall be the same as that prescribed in Section 10.68.060. SECTION II. Section 12.60.230 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 12.60.230 Licensed motorized vehicles not to be operated when. No motorized vehicles which may be legally licensed in the state may be operated in or on any parks or public lands covered by this chapter, except on roadways or parking areas specifically provided for this purpose, except city owned maintenance vehicles any vehicles operated by employees of or incidental to the function of any federal, state or municipal governmental body or any subdivision thereof; SECTION III. Section 12.60.240 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: 12.60.240 Unlicensed motorized vehicles not to be operated when. No motorized vehicle which cannot be legally licensed in the state may be operated in or on any parks or public lands covered by this chapter, except vehicles operated by employees of or incidental to the function of any federal, state or municipal governmental body or any subdivision thereof or as otherwise provided in this chapter.
