RESOLUTION AUTHORIZING THE PURCHASE OF A LIABILITY INSURANCE
POLICY AS EVIDENCE OF PROVIDING FINANCIAL RESPONSIBILITY FOR
LANDFILL CLOSURE AND LONG-TERM CARE
WHEREAS, the City of Janesville holds a license to operate a solid waste disposal
facility; and
WHEREAS, Section 144.443 of the Wisconsin Statues and Section NR 520.06 of the
Wisconsin Administrative Code require that any City holding such a license must provide
evidence of financial responsibility for the closure and long-term care of the licensed facility to
the Wisconsin Department of Natural Resources (DNR); and
WHEREAS, Section NR 520.06 of the Wisconsin Administrative Code states that, one of
the methods of establishing proof of financial responsibility is for the City to submit to the DNR
an insurance policy that would assure funds would be available to the DNR to carry out the
closure and long-term care requirements of the approved plan of operation, if the owner fails to
do so; and
WHEREAS, the Sanitation Fund maintains sufficient funding to purchase such an
insurance policy; and
WHEREAS, Common Council finds that it is in the best interest of the City to use this
approved method of evidencing financial responsibility to the DNR; and
NOW, THEREFORE BE IT RESOLVED, that the Common Council of the City of
Janesville hereby authorizes the City Manager to acquire such an Insurance policy, subject to the
policy's review and approval of the Wisconsin Commissioner of Insurance, and subsequent
acceptance of the DNR.
