2000-98RESOLUTION NO. 2000-98 A Resolution Establishing Common Council Policy No. 79 on Assessing the Local Share of Major State/Federal Funded Highway Projects to abutting and/or benefited properties. WHEREAS, the Janesville Common Council find that a policy on assessing the cost of the local share of state/federal funded major highway projects to abutting and/or benefited property owners under one or more of the means provided for such assessments in the Wisconsin State Statutes is reasonable, equitable and appropriate as a guide for the City Administration and to Janesville and its property owners, business, industry, residents and taxpayers, and in their benefit and best interest; and WHEREAS, the Janesville Common Council find that the guidelines included as part of the City Council Policy 79 are a fair and equitable means of financing the local share of major highway projects; and WHEREAS, the Janesville Common Council find it necessary and desirable that the City Administration shall follow these policy guidelines when presenting state/federal funded major highway projects to the Common Council for approval and funding on a project by project basis. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Janesville that Janesville Common Council Policy Statement No. 79 be and hereby is adopted effective forthwith to read as follows: "CITY OF JANESVILLE CITY COUNCIL POLICY STATEMENT General Subject: Administration Specific Subject: Special Assessments for the Local Share of Major Highway Projects Policy No 79 Date Issued 1/1/2001 Effective Date 1/1/2001 PURPOSE: To clarify and establish Council Policy in regard to the assessment of the local share of maj or highway projects primarily funded with state or federal aid. STATEMENT OF POLICY: The following guidelines should be followed by the City Administration when preparing and presenting state and/or federally funded major highway projects to the Common Council for approval and funding: Residential properties that front (abut directly upon) state/federal funded major highway projects/improvements shall be assessed and pay a pro rata portion (percentage) of the City's assessment rate established in accordance with Council Policy No. 63 equal to the percentage of the local share. The General Fund will fund the remaining local share cost(s). 2. The City's local share cost(s) of major highway projects/improvements designed to increase the capacity to serve multi-family/commercial/industrial properties in addition to serving the general public shall be funded 50% by the General Fund. The remaining 50% shall be funded by pro rata assessment of and payable by the abutting and/or benefiting property owners. The total local share of state/federal funded major highway projects in which the primary or substantial purpose of the project/improvements is/are to benefit multi-family/commercial/and industrial properties shall be funded by pro rata assessment of and payable by the abutting and/or benefiting multi-family/commercial/industrial properties for 100% of the entire local share cost(s)."
