2000-86RESOLUTION NO. 2000-86 A resolution vacating a portion of the West Wall Street right-of-way east of Madison Street. WHEREAS, a portion of the West Wall Street right-of-way east of Madison Street designated and previously dedicated for right-of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, said street portion is not essential for use and the applicant, who owns the adjoining properties, desires to utilize said lands for the expansion of the existing use on those sites; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin Statutes; and WHEREAS, a public hearing was held on the vacation of such street portion and notice served as required by 66.296, Wisconsin Statutes; NOW THEREFORE LET IT BE RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described portion of West Wall Street be and is hereby vacated and discontinued pursuant to 66.296 and 66.22(lm), Wisconsin Statutes: Part of the SW ~A of the NW lA of Section 36, T.3N., R. 12E. of the 4th p.m., City of Janesville, Rock County, Wisconsin, described as follows: Commencing at the southernmost corner of Lot 2 of a Certified Survey Map Number 1358131 as recorded in Volume 21 Page 30 of Certified Survey Maps of Rock County, Wisconsin; thence north along the west line of said Lot 2, also being the east right-of-way line of Madison Street, 139.84 feet to the westernmost corner of said Lot 2 and the point of beginning for the land herein described; thence N 62°40'20"E 87.69 feet; thence N33°50'25' 136.86 feet to a point on the south line of Lot 6, Mitchell's Addition to the City of Janesville, also being the north line of West Wall Street; thence southwest along the south line of said Lot 6 173.41 feet to a point on the east right-of-way line of Madison Avenue; thence south along said east line projected 70.0 feet more or less to westernmost corner of aforesaid Lot 2 and the point of beginning. NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains an easement for utility purposes over the entire land area herein described.
