A resolution vacating a utility easement on property located at 906 Kellogg Avenue.
WHEREAS, an 8.0 foot wide utility easement was created along the west line of Lot 17, Damrow's
First Addition to the City of Janesville, Document Number 942541, as recorded with the Rock County
Register of Deeds, Rock County, Wisconsin, in Volume 31, Page 29 of Plats; and
WHEREAS, the owner of the property on which the easement is located desires to redevelop the site
by building over the easement and has requested that the City release its rights to said easement; and
WHEREAS, City of Janesville Staff has determined that said easement is not now used nor essential
for future use in providing City utility service to the site or other properties in the area; and
WHEREAS, on 5 July 2000 the Janesville Plan Commission reviewed the release of the existing
easement and found said action to be consistent with city plans, provided that the applicant be
responsible for the cost of relocation of any City utility facilities that may be necessary as a result of
said easement release as well as the granting of any new easement that may be necessary to provide
continued service to the area; and
WHEREAS, the City Council finds the release of the existing easement consistent with the public
interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CIT OF
JANESVILLE that City of Janesville hereby releases all rights to the following described easement:
Part of the NW la of Section 12, T. 2 N., R. 12 E. of the 4th P. M., City of Janesville, Rock
County, Wisconsin, Described as follows:
An 8.0 foot wide utility easement as dedicated along the west line of Lot 17, Damrow's First Addition
to the City of Janesville, Document Number 942541, as recorded in Volume 31, Page 29 of Plats of
Rock County, Wisconsin.
BE IT FURTHER RESOLVED that upon adoption of this resolution the City Clerk is directed to
record a certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus
granting the release of the heretofore described easement.
