2014-583 ORDINANCE NO. 2014 - 0583
An ordinance requiring residential Janesville Utility bills be placed in the name of the property
owner unless certain criteria is met with penalties as set forth in JGO 8.64.580,13.04.200,
13.10.150, and 13.18.130.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
SECTION I. Section 8.64.550 of the Code of General Ordinances of the City of Janesville is
hereby amended to read as follows:
8.64.550 BILLING
A. The billing schedule for the solid waste collection and disposal fee shall coincide with
the billing schedule for the Janesville Water Utility and the Janesville Stormwater Utility. The
fee shall be due and payable to the City Treasurer at the same time that the Water Utility bills are
payable but in no event sooner than the first billing statement sent to customers for the fee each
calendar year.
B. Residential bills shall be placed in the name of the property owner except as permitted
in Section 8.64.550 (C).
C. Residential property owners may have the bill placed in the name of the tenant if the
following conditions are met:
1. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the owner.
2. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the tenant who is responsible for payment of the utility charges.
3. If requested by the utility, the owner of the rental dwelling unit provides the utility
with a copy of the rental or lease agreement in which the tenant assumes responsibility for the
payment of the utility charges.
D. In order to comply with the requirements of Section 8.64.550 (C) the property owner
must complete a written application in compliance with the operating policies of the Janesville
Utility.
SECTION II. Section 13.04.035 of the Code of General Ordinances of the City of Janesville is
hereby created to read as follows:
13.04.035 Billing.
A. Residential bills shall be placed in the name of the property owner except as
permitted in Section 13.04.035 (B).
B. Residential property owners may have the bill placed in the name of the tenant if the
following conditions are met:
1. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the owner.
2. The owner of the rental dwelling unit notifies the utility in writing of the name
and address of the tenant who is responsible for payment of the utility charges.
3. If requested by the utility, the owner of the rental dwelling unit provides the
utility with a copy of the rental or lease agreement in which the tenant assumes responsibility for
the payment of the utility charges.
C. In order to comply with the requirements of Section 13.04.035 (B) the property owner
must complete a written application in compliance with the operating policies of the Janesville
Utility.
SECTION III. Section 13.10.080 of the Code of General Ordinances of the City of Janesville is
hereby amended to read as follows:
13.10.080 Billing.
A. The Stormwater Utility billing schedule shall coincide with the billing schedule for
the Janesville Water Utility. Stormwater Utility charges shall be due and payable to the City
Treasurer at the same time that the Water Utility bills are payable.
B. Residential bills shall be placed in the name of the property owner except as permitted
in Section 13.10.080 (C).
C. Residential property owners may have the bill placed in the name of the tenant if the
following conditions are met:
1. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the owner.
2. The owner of the rental dwelling unit notifies the utility in writing of the name
and address of the tenant who is responsible for payment of the utility charges.
3. If requested by the utility, the owner of the rental dwelling unit provides the
utility with a copy of the rental or lease agreement in which the tenant assumes responsibility for
the payment of the utility charges.
D. In order to comply with the requirements of Section 13.10.080 (C) the property owner
must complete a written application in compliance with the operating policies of the Janesville
Utility.
SECTION IV. Sections 13.18.070 (C) & (D) of the Code of General Ordinances of the City of
Janesville is hereby created to read as follows:
13.18.070 Sewer service charges, surcharges and pretreatment program charges
Payment procedure.
C. Residential property owners may have the bill placed in the name of the tenant if the
following conditions are met:
1. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the owner.
2. The owner of the rental dwelling unit notifies the utility in writing of the name and
address of the tenant who is responsible for payment of the utility charges.
3. If requested by the utility, the owner of the rental dwelling unit provides the utility
with a copy of the rental or lease agreement in which the tenant assumes responsibility for the
payment of the utility charges.
D. In order to comply with the requirements of Section 13.18.070 (C) the property owner
must complete a written application in compliance with the operating policies of the Janesville
Utility.
