A resolution granting an easement to SBC Wisconsin across a portion of City-owned land
at 2604 Mineral Point Avenue.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of property located in
the Southeast Quarter (SE 1/4) of the Southeast Quarter (SE 1/4) of Section 27 ofT.2N., R. 12E.
in the 4th P.M., City of Janesville, Rock County, Wisconsin;
WHEREAS, SBC Wisconsin finds that in order to better serve its customers and expand
communications services, it is necessary to obtain an easement to locate utility facilities on and
across certain lands owned by the City of Janesville; and
WHEREAS, the City Planning, Engineering, Leisure Services and Public Works staff have
determined that the location of the proposed easement does not conflict with the current or
planned future use of city-owned lands in the easement area; and
WHEREAS, SBC Wisconsin has agreed to provide financial compensation to the City for the
granting of the easement in the amount of $1,500; and
WHEREAS, on 2 June 2003 the Janesville Plan Commission, pursuant to Section 62.23,
Wisconsin Statutes, reviewed the granting of this easement to SBC Wisconsin and found it to be
consistent with City plans but did not review the financial aspects of the transaction; and
WHEREAS, providing this easement is in the best interest of the City and its residents; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the City of Janesville hereby grants the easement located in
Section 27 ofT.2N., R. 12E. of the 4th P.M., City of Janesville, Rock County, Wisconsin, to SBC
Wisconsin as described below:
A strip of land 10 feet in width and 50 feet in length being the easterly 10 feet of the
westerly 30 feet of Lot 1, Block 4 of the Country Club Estates Addition to the City of
Janesville.
BE IT FURTHER RESOLVED that the City Manager and City Clerk of the City of Janesville
are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of
Janesville, a proposed easement between the City and SBC Wisconsin, prepare and file such
other documents, forms and papers pertaining to this transaction as may, from time to time, be
necessary or desirable to effectuate the intent of this resolution and/or easement.
