2014-1115 RESOLUTION NO. 2014 -1115
A resolution releasing two utility easements on property located at 2715 West Burbank Avenue.
WHEREAS, a 5 -foot wide utility easement was dedicated along the south line of Lot 2, Block 9, Guy L.
Nichols' Valley Park; as recorded in Volume 18, Page 19 of Plats of Rock County, Wisconsin; and
WHEREAS, and an 8 -foot utility easement was dedicated along the north lot line of Outlot 3, Wick
Addition, as recorded in Volume 32, Page 187 of Plats, Rock County, Wisconsin; and
WHEREAS, the owner of said property requests that the City release its rights to the existing easements;
and
WHEREAS, there are no existing public utilities within said easements; and
WHEREAS, the City Council finds the release of the existing easements consistent with the public
interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE
that the City of Janesville hereby releases all rights to the following described easements:
Located in SE % of Section 10, T.2N., R.12E. of the 4 P.M. City of Janesville, Rock County, Wisconsin,
described as follows:
The south 5 feet of Lot 2, Block 9 of Guy L Nichols' Valley Park as recorded in Volume 18, Page 19 of
Plats, Rock County, Wisconsin; excepting the east 10 feet thereof; and
The north 8 feet of Outlot 3, Wick Addition, as recorded in Volume 32, Page 187 of Plats, Rock County,
Wisconsin, excepting the east 10 feet thereof; and
BE IT FURTHER RESOLVED that said easements released by the City of Janesville does not relinquish
any inherent rights that other utility companies serving the area may have to use said easements.
BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is directed to record a
certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the
easement releases as herein described.
