2014-1113 RESOLUTION NO. 2014 -1113 A resolution authorizing the City Manager to enter into a Memorandum of Understanding with Mercy Health System for Relocation of Existing Storm Sewer at their Mineral Point Facility WHEREAS, Mercy Health System Corporation (hereinafter Mercy) owns certain real property at 1000 Mineral Point Avenue in Janesville, which includes the Mercy Hospital and Trauma Center; and WHEREAS, Mercy desires to construct a 6,000 square foot expansion to this medical facility that includes an ambulance garage expansion (herein after Development) that will provide Mercy with the ability to house several ambulances at one time; and WHEREAS, the City of Janesville (hereinafter City) prefers to reroute the existing storm sewer facility and easement to the right of way along Mineral Point Ave. and North Franklin Street to accommodate this development; and WHEREAS, a certain Memorandum of Understanding (MOU) between the City and Mercy, a true and correct photocopy of which is attached hereto and incorporated herein as if fully set forth verbatim, which sets forth and specifies certain binding terms and conditions associated with the development; and WHEREAS, Mercy agrees to pay for the preparation of all construction and bid documents and reimburse for reasonable City inspection services; and WHEREAS, the City agrees to pay for the construction costs related to this public improvement projects with funds from TIF 33 in an amount not to exceed $125,000.00; and WHEREAS, the Common Council hereby find that facilitating this development and rerouting of the existing storm sewer is in the best interest of the public and benefit of the community. NOW, THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City Manager, City Clerk, and his /her designee(s) are authorized to negotiate, enter into, and execute, on behalf of the City of Janesville, the attached MOU and to expend TIF monies in accordance with the MOU; and to negotiate, draft, execute, record, and file such documents, papers and forms as may, from time to time and at any time, be necessary and /or desirable to effectuate the MOU and /or the intent of this resolution as the City Manager may decide; and BE IT FUTHER RESOLVED BY THE COMMON COUNCIL that the City Manager and his designee(s) are hereby authorized to take at any time and from time to time whatever other actions and make whatever changes to the MOU that the City Manager may determine necessary and /or desirable to effectuate the intent of this resolution.
