Minutes 03-10-03.docPROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING March 10, 2003 Approved: March 24, 2003 VOL. 53 NO. 27 Regular meeting of the Janesville City Council held in the Municipal Building on March 10, 2003. The meeting was called to order by Council President DeGarmo at 7:00 p.m. Council President DeGarmo led the Council in the Pledge of Allegiance. Present: Council President DeGarmo, Councilmembers Steeber, Murphy, Brien, Damron, Williams, and O'Leary. CONSENT AGENDA Minutes of the regular meeting of February 24, 2003. Minutes of the closed session of February 24, 2003. Licenses; and Recommendations of the Alcohol License Advisory Committee. Action on a motion to approve final Certified Survey Map #03006-C, Harmony Development c/o Lein Oil, 2 lots on Commercial Drive. Action on a motion to approve final Certified Survey Map #03007-C, City of Janesville, 1 lot on Kennedy Road. Action on a motion to approve final Certified Survey Map #03003-C, Norm Weitzel, 2 lots on Midland Road. Waiver of special assessment procedure for storm sewer and street light charges for CSM 03003, Weitzel. Waiver of special assessment procedures for storm sewer, sidewalk and street light charges for Twelve Oaks Third Addition, Twelve Oaks Development. Council President DeGarmo stated that the Consent Agenda would be approved as recommended if there were no objections. There were none. Annette Baker, Bill Brudenstein, and Tom Luedtke presented an award from the American Heart Association, Greater Janesville Division, to Council President DeGarmo for passing the non-smoking ordinance in the City of Janesville. OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. Ty Bollerud, 424 South Pearl Street, stated the City should actively pursue obtaining more federal funds. Richard Frank, 1119 Elida Street, stated his concern with the Department of Revenue's review of his 2002 assessment. Council President DeGarmo requested that Mr. Frank forward his concerns in writing to the Administration. 2. A proposed ordinance removing the truck route designation on East and West Racine Street (former State Trunk Highway 11) from Center Avenue to 1-90 received its second reading and public hearing. Richard Frank, 1119 Elida Street, stated it was difficult to follow the truck routes in Janesville. Edward JaDoul, 1015 East Racine Street, supported the ordinance. The public hearing was closed. Councilmember Brien moved to adopt said ordinance, seconded by Councilmember Steeber. Councilmember Steeber offered a friendly amendment to remove the truck route designation on West Court Street from Center Avenue to Jackson Street and South Jackson Street from Court Street to Racine Street which was accepted. Council voted on the amended motion and it passed by the following vote: Aye: Councilmembers Steeber, Damron, Williams, DeGarmo, Brien, and O'Leary. Nay: Councilmember Murphy. (File Ord. No. 2003-171) NEW BUSINESS 1. Recommendation of the Plan Commission: Action on a proposed resolution approving the final plat of Heider Estates First Addition. Councilmember Williams moved to adopt said resolution, seconded by Councilmember Steeber and it passed unanimously. (File Res. No. 2003-344) 2. A proposed resolution accepting the gift of land for public purposes. Councilmember Steeber moved to adopt said resolution, seconded by Councilmember Williams and it passed unanimously. (File Res. No. 2003-356) 3. A preliminary resolution declaring the intent to exercise special assessment powers for Public Works Projects Bid Schedule "B" - 2003. Councilmember Steeber moved to adopt said resolution, seconded by Councilmember O'Leary and it passed unanimously. Council President DeGarmo scheduled a public hearing for the final resolution on April 14, 2003. (File Res. No. 2003-357) 4. Matters not on the Agenda. Councilmember Brien informed the Administration of the increase in gang graffiti around Fourth Ward Park and Marshall Middle School.
