A Resolution Opposing the Designation of Rock County as a Non-Attainment Area for Ozone
WHEREAS, the federal Environmental Protection Agency has issued an air quality standard for ozone
under the provisions of the Clean Air Act and has set forth a procedure and schedule for identifying
and designating counties that do not attain the air quality standard; and
WHEREAS, the Wisconsin Department of Natural Resources is reviewing air quality data for the years
2000, 2001, and 2002 to determine which Wisconsin counties have not met the air quality standard for
ozone and which counties may be contributing to the poor air quality of areas downwind; and
WHEREAS, by July 15, 2003 the Governor of the State of Wisconsin must recommend to the EPA,
which Wisconsin counties should be designated as "non-attainment" areas for ozone;
WHEREAS, Wisconsin Statutes §285.01 (30) defines non-attainment as an area where the
concentration in the atmosphere of an air contaminate exceeds an ambient air quality standard; and
WHEREAS, the Rock County and the upwind counties of Boone and Winnebego Counties in Illinois,
have met the air quality standard for ozone for the years 2000, 2001 and 2002; and
WHEREAS, designation as a "non-attainment" area for ozone will have a negative economic impact as
companies deal with increased permitting requirements and expensive pollution control technologies,
as communities deal with additional transportation conformity planning requirements for needed
transportation projects, and citizens may deal with increased vehicle inspection and maintenance
requirements; and,
NOW, THERFORE, BE IT RESOLVED by the Common Council of the City of Janesville that the
City of Janesville is opposed to the designation of Rock County as a non-attainment area for ozone in
any recommendation made by the Department of Natural Resources to the Governor and in any
recommendation made by the Governor to the Environmental Protection Agency until such time as the
air quality monitoring data for ozone shows that Rock County no longer meets the Clean Air Act
standards; and
BE IT FURTHER RESOLVED that the City Council recommends that the Department of Natural
Resources relocate the Rock County air quality monitoring station from Beloit to a more centrally
located county location that more accurately reflects the relative ozone concentrations throughout Rock
County; and

BE IT FURTHER RESOLVED, that the City Clerk is hereby directed to send a copy of this Resolution
to the Governor, the Secretary of the Department of Natural Resources; and the Director of DNR's
Bureau of Air Management.
