2003-379RESOLUTION No. 2003-379 A Resolution Authorizing the City Manager to Enter Into an Intergovernmental Purchase Agreement Pursuant to Wisconsin Statutes, Section 66.0301. WHEREAS, The City of Janesville, Wisconsin and the City of Appleton, Wisconsin both operate municipal transit systems as defined by Wisconsin Statutes, Section 85.20; and, WHEREAS, in order to increase the efficiency of their transit systems and make the best use of scarce public funds, the City of Janesville, Wisconsin and the City of Appleton, Wisconsin desire to enter into an Intergovernmental Joint Purchase Agreement for the procurement of new low-floor transit buses at the most competitive prices available; and, WHEREAS, the Common Council of Janesville hereby find that such a joint purchase agreement would facilitate the above legitimate public purpose and be of benefit to each community and its residents, businesses, bus riders and taxpayers; and, WHEREAS, both the City of Janesville, Wisconsin and the City of Appleton, Wisconsin are eligible and have received funds under Section 5309 of the Federal Transit Act to underwrite Eighty (80) Percent of the cost of the acquisition of said buses; and, WHEREAS, both the City of Janesville, Wisconsin and the City of Appleton, Wisconsin have appropriated sufficient local funds to cover the remaining Twenty (20) Percent of the cost of the acquisition of the buses; and, WHEREAS, Wisconsin Statutes, Section 66.0301 (2) of the Wisconsin Statutes allows municipalities to enter into intergovernmental cooperative agreements including, but not limited to, contracts for the purchase of municipal goods and services, and to jointly exercise any power authorized by law; and, WHEREAS, The City of Janesville, Wisconsin and the City of Appleton, Wisconsin, are "municipalities" as defined by Section 66.0301 (1)(a) of the Wisconsin Statutes. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Janesville, Wisconsin, that: The above recitals are reiterated and incorporated herein as if fully set forth verbatim; and The City Manager and his designee(s) are jointly and severally authorized to enter into an Intergovernmental Joint Purchase Agreement with the City of Appleton, Wisconsin for the purchase of transit buses in the manner set forth above; and BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the City of Janesville, is/are hereby jointly and severally authorized and empowered to negotiate, draft, review, revise, modify, amend, execute, enter into, file and/or record additional agreements, amendments, documents and letters of understanding concerning this matter, and to take whatever additional other actions that the City Manager may determine in his sole discretion, from time to time and at any time, necessary and/or desirable in the public interest to effectuate the intent of this Resolution.
