2003-347RESOLUTION NO. 2003-347 A resolution authorizing the City Manager to proceed with the sale of surplus City lands located along Ruger Avenue east of Wuthering Hills Drive. WHEREAS, the City of Janesville owns the following described parcels of real property: PARCEL A (western parcel) Part of the NE. 1/4 of Section 33, T.3N., R. 13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin, described as follows: Commencing at an aluminum monument at the NE comer of said Section 33; thence S.59°57' 14"W. 2657.07 feet to a point 40 feet southerly (at right angles) of the centerline of Ruger Avenue, also being at the place of beginning for the land to be herein described; thence S.79°01 '35"E 356.62 feet; thence S.64°57' 15"E. 79.50 feet; thence S.25°02'45"W. 135.00 feet; thence N.79°01 '35"W. 400.91 feet; thence N. 10°58'25"E. 150.28 feet to the place of beginning. PARCEL B (central parcel) Part of the NE ¼ of Section 33, T.3N., R. 13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. Described as follows: Commencing at the southeast comer of Lot 1 of Oakland Valley Subdivision, a recorded plat; thence southwesterly and perpendicular to the south right-of-way line of Ruger Avenue 70 feet more or less to a point along said right-of-way-line; thence northwesterly along said right-of-way line 160 feet more or less to the place of beginning; thence southwesterly and perpendicular to said right-of-way line 160 feet more or less; thence northwesterly and parallel to said right-of-way line 150 feet more or less; thence northerly 200 feet more or less to a point along the south right-of-way line of Ruger Avenue; thence southeasterly along said right-of-way line 270 feet more or less to the place of beginning. PARCEL C (eastern parcel) Part of the NE ¼ of Section 33, T.3N., R. 13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. Described as follows: Commencing at the southeast comer of Lot 1 of Oakland Valley Subdivision, a recorded plat; thence southwesterly and perpendicular to the south right-of-way line of Ruger Avenue 70 feet more or less to a point along said right-of-way-line, also being the place of beginning; thence continuing southwesterly 130 feet more or less; thence southeasterly and parallel to said right-of-way line 600 feet more or less; thence northeasterly and perpendicular to the south right-of-way line of Ruger Avenue 130 feet more or less to a point along said right-of-way line; thence northwesterly along said right-of-way line 600 feet more or less to the place of beginning. WHEREAS, the property consists of approximately 4 acres of land located on Ruger Avenue adjacent and north of Phase II of the Youth Sports Facility has been deemed inappropriate for construction of athletic fields and parking, because of its physical constraints and proximity to existing residential, but is desirable for residential development; and WHEREAS, the Plan Commission has reviewed the matter at its meeting held on February 3, 2003, and has recommended that this property be declared surplus land and that the City Council authorize the City Manager to proceed with the sale of this property, but has not reviewed the financial aspects of this transaction; and WHEREAS, the Common Council of the City of Janesville does hereby find that this property is surplus and is no longer needed for City purposes and that the proposed transaction is to the benefit and in the best interest of the citizens and the City of Janesville. NOW THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL of the City of Janesville that it hereby authorizes and directs the City Manager and the City Clerk to negotiate, enter into and execute, on behalf of the City of Janesville, the sale of such property; and to negotiate and execute such documents, papers and forms as may from time to time, be necessary and/or desirable to effectuate such transactions and the intent of this resolution as the City Manager may decide; and BE IT FURTHER RESOLVED, that the City Manager is hereby authorized to take whatever other actions or to make whatever other minor changes that may be necessary to effectuate this land transaction.
