2014-553 i ORDINANCE NO. 2014 – 553 An ordinance allowing bow and cross bow hunting, and certain animal trapping, on private lands within the City's limits, with certain exceptions, as mandated by recently enacted state law (2013 Act 71), with penalties for violations thereof respectively as set forth in JGO 9.87.040 and 6.20.030. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 9.87.012 of the Code of General Ordinances of the City of Janesville is hereby created to read as follows: "9.87.012 Bow and cross bow hunting – Restrictions. Bow and crossbow hunting are permitted, but not on any municipally owned land and not within 100 yards of any permanent building or structure used for human occupancy on another person's land. This distance restriction does not apply if the person who owns the land on which the building or structure is located allows the hunter to hunt within 100 yards of the building or structure. All bows and crossbows shall be discharged toward the ground (e.g. from a tree stand)." SECTION II. Chapter 6.20 of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: Chapter 6.20 TRAPPING* Sections: 6.20.010 Prohibited generally Trapping of wild animals 6.20.020 Prohibition exemptions. 6.20.030 Violation -- Penalty. 6.20.010 Trapping of wild animals. . No person, firm or corporation shall, within the city limits, trap any animal, wild, domesticated or otherwise, nor place, lay or in any other manner . e. j Trapping of wild animals is permitted, but not on publicly owned land, except as provided in Section 6.20.020. 6.20.020 Prohibition exemptions. " - • _ - - - - • - • • • • . A. The prohibition in Section 6.20.010 shall not apply to the owner of any land who sets animal pests. The prohibition in Section 6.20.010 shall also not apply to any federal, state, or local "oven ental official who is setting traps as a part of any act within the scope of such official's office. B — Traps shall be allowed in certain publicly owned areas subject to approval by city administration. Such traps may be set only in the months of November and December and must be set in a minimum of three inches of water and will not be allowed on dry land. Permitted traps must be conibear traps of a size for muskrat trapping only. Twenty -five traps are the maximum number allowed per trapper. The city is not responsible for any damages that arise from the use of any traps. (Prior code s. 17.14(2)).
