A resolution releasing a portion of a sanitary sewer easement in Clearview Court in the Hickory
Meadows PUD.
WHEREAS, a thirty (30) foot wide utility easement was dedicated with the recording of the Hickory Meadows
Planned Unit Development as recorded on June 24, 1982, as Document No. 954454 in the Office of the
Register of Deeds for Rock County, Wisconsin.
WHEREAS, the owner of vacant development sites within the Hickory Meadows PUD has requested the
release of a 5-foot portion of the existing 30 foot wide utility easement in order to facilitate the construction of
a two-family condominium on the site; and
WHEREAS, said utility easement portion has not been used for municipal facilities and is no longer needed
for utility purposes; and,
WHEREAS, the City Council finds that the release of said utility easement portion will not be contrary to the
public interest.
NOW, THEREFORE, BE IT RESOLVED that said utility easement portion as described below shall be
released:
LOCATED IN THE HICKORY MEADOWS CONDOMINIUM, ROCK COUNTY, WISCONSIN AND
LOCATED IN THE NE.l/4 OF THE NE.l/4 OF SECTION 27, T.3N., R. 12E. OF THE 4TM P.M., CITY OF
JANESVILLE, ROCK COUNTY, WISCONSIN, DESCRIBED AS FOLLOWS:
Commencing at the NE. comer of said Section; thence N.89°37'15"W. along the North line of the NE. 1/4 of
said Section, 676.12 feet; thence S.0°27'15"E. 281.40 feet; thence S.85°00'W. 149.81 feet to the intersection of
the North line of an existing 30 foot utility easement and the West line of Court D of said Hickory Meadows
Condominium; thence S.85°00'W. 25.0 feet to the place of beginning; thence S.3°00'E. 5.0 feet; thence
S.85°00'W. 55.0 feet; thence N.3°00'W. 5.0 feet to said North line of said Easement; thence N.85°00'E. along
said North line 55.0 feet to the place of beginning.
BE IT FURTHER RESOLVED THAT upon adoption of this resolution, the City Clerk is directed to record a
certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the
easement release as herein described.
