2002-314RESOLUTION NO. 2002-314 A resolution authorizing the City to obtain and accept an easement from Union Pacific for the Kiwanis Trail. WHEREAS, the Union Pacific has offered to sell the City two easements which will facilitate the paving of a portion of the Kiwanis Trail located north of Mineral Point Avenue and east of Mercy Hospital described as follows: Parcel 1 A strip of land 10 feet in width, more particularly described as those part of Lots 11, 12 and 13 in Croft's Addition to Janesville, a recorded subdivision in the City of Janesville, Rock County, State of Wisconsin; recorded November 9, 1853 in Volume 2, Page 35 at the Rock County Register of Deeds, between lines parallel with and distant 15 feet and 25 feet Northeasterly, measured at right angles, from the center line of the main track of Union Pacific Railroad Company. Parcel 2 A strip of land 35 feet in width, more particularly described as those parts of Lots 3, 4, 5, 6 and 7 in Geo. Hield's Addition to Janesville, a recorded subdivision in the City of Janesville, Rock County, Wisconsin; recorded November 5, 1856 at the Rock County Register of Deeds, between lines parallel with and distant 25 feet and 60 feet Northeasterly, measured at right angles, from the center line of the main track of Union Pacific Railroad Company. WHEREAS, this easement acquisition is consistent with the Janesville Parks and Open Space Plan and will complete the improvement to the Kiwanis Trail and provide an approximate 1.6 mile section of continuous paved trail from River Street north to Riverside Park; and WHEREAS, the Janesville Plan Commission reviewed this acquisition on 2 December 2002 and found it consistent with City plans and unanimously forwarded a favorable recommendation to the City Council. NOW, THEREFORE BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that it hereby authorizes and directs the City Manager and the City Clerk, on behalf of the City of Janesville, to purchase and acquire the above-described easements and to negotiate, draft, amend, file and execute such documents as the City Manager may from time to time determine necessary and/or desirable to acquire the above-described easement and/or effectuate the intent of this resolution, in an amount not to exceed $6,000 plus additional fees for routine filing and recording of legal documents; and BE IT FURTHER RESOLVED, that the City Manager and his designee are hereby authorized to take whatever other action, enter into whatever other negotiations, and to make whatever minor changes to these transactions, purchases, funds and related documents that the City Manager may, from time to time, find necessary and/or desirable to effectuate the intent of this transaction.
