2002-309RESOLUTION NO. 2002-309 A resolution vacating a portion of Butler Drive north of Twelve Oaks Drive. WHEREAS, a portion of Butler Drive north of Twelve Oaks Drive designated and previously dedicated for tight-of-way purposes is hereby determined to be no longer needed for public use, and therefore, the public interest requires the vacation of such street portion; and WHEREAS, it has been determined that the traffic flow will not be impeded by the vacation of such street portion; and WHEREAS, the proposed street vacation has been referred to the Plan Commission for its consideration and report as required by 62.23(5), Wisconsin Statutes; and WHEREAS, a public hearing was held on the vacation of such street portion and notice served as required by 66.296, Wisconsin Statutes; NOW THEREFORE LET IT BE RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the following described portion of Butler Drive be and is hereby vacated and discontinued pursuant to 66.296 and 66.22(lm), Wisconsin Statutes: Part of the NW 1/4 of Section 8, T.3.N, R. 13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin. Described as follows; Commencing at the southeast comer of lot 43, of Twelve Oaks First Addition, a recorded subdivision, thence North 24°21'15" West, a distance of 82.93 feet; thence South 64°31'15'' East, a distance of 108.52 feet; thence South 65038'45'' West, a distance of 70.00 feet to the Point of Beginning. Said parcel containing 0.07 acres. NOW THEREFORE BE IT FURTHER RESOLVED that the City of Janesville hereby retains an easement for utility purposes over the entire land area herein described.
