A Resolution Granting an Ingress and Egress Access Easement across the Northwest
Corner of Marquette Park to Steven Dean, owner of property at 1121 Center Avenue.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of certain real
property known as "Marquette Park" located in part of Block 16, of Overlook Heights Addition
No. 2, a recorded subdivision in the Southwest Quarter (SW 1/4) of Section 1, T2N, R12E, of the
4th P.M.; City of Janesville, Rock County, Wisconsin.
WHEREAS, the City Planning, Engineering, Leisure Services and Public Works finds that the
proposed easement will lessen traffic conflicts associated with ingress to and egress from the
subject property located at 1121 Center Avenue and have further determined that said easement
does not conflict with the current or planned future use of city-owned land in the easement area;
and
WHEREAS, the Grantee, Steven Dean, has submitted an offer to provide financial
compensation to the City for the granting of the easement in the amount of $10,000.00; and
WHEREAS, this compensation shall be placed into the Parkland Special Revenue Account; and
WHEREAS, the Janesville Plan Commission, pursuant to Section 62.23, Wisconsin Statutes,
reviewed the granting of the easement to Steven Dean and found it to be consistent with City
plans but did not review the financial aspects of the transaction; and
WHEREAS, providing the easement is in the best interest of the City and its residents; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that the City of Janesville hereby grants the following described
easement located in part of Block 16, of Overlook Heights Addition No. 2 a recorded subdivision
in the Southwest Quarter (SW 1/4) of Section 1, T2N, R12E, of the 4th P.M.; City of Janesville,
Rock County, Wisconsin to Steven Dean, as described as follows:
The east 53 feet of the west 113 feet of Block 16 Overlook Heights Addition No. 2 a
recorded subdivision in the Southwest Quarter (SW 1/4) of Section 1, T2N, R12E, of the
4th P.M.; City of Janesville, Rock County, Wisconsin.
BE IT FURTHER RESOLVED that the City Manager and City Clerk of the City of Janesville
are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of
Janesville, a proposed easement between the City and Steven Dean, prepare and file such other
documents, forms and papers pertaining to this transaction as may, from time to time, be
necessary or desirable to effectuate the intent of this resolution and/or easements; and
AND BE IT FURTHER RESOLVED that the compensation shall be placed into the Parkland
Special Revenue Account.
