RESOLUTION NO. 2002-272
A Resolution authorizing the expenditure of bicycle and pedestrian trail construction funds and a
revised Project Agreement with the Wisconsin Department of Transportation for State Trunk
Highway 11, Janesville Bypass, West.
WHEREAS, the Wisconsin Department of Transportation has scheduled the relocation and
construction of State Trunk Highway 11, from Hayner Road to Center Avenue, including bike
trail construction from Afion Road to South Oakhill Avenue, in 2001 and 2002; and
WHEREAS, the Common Council of the City of Janesville previously authorized said Highway
11 Bypass Project with the Wisconsin Department of Transportation when the City Council
authorized Resolution No. 2001-112 on January 8, 2001 and Resolution No. 2001-170 on June
11, 2001; and
WHEREAS, the Wisconsin Department of Transportation now proposes to extend said bike trail
from South Oakhill Avenue to Center Avenue at an estimated total cost of $142,000; and
WHEREAS, the City of Janesville's share of the said bike trail extension is limited to 20% of
the design and construction, now estimated to be $28,400; and
WHEREAS, the City of Janesville has received financial compensation for easements along
Highway 14 granted to electric utility companies; and
WHEREAS, said financial compensation was designated for bicycle and pedestrian trail
construction when the City Council authorized Resolution No. 2002-239.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Janesville,
that the City Council intends to fund the City's share of said bicycle trail extension from
construction funds designated for bicycle and pedestrian trail construction; and
BE IT FURTHER RESOLVED by the Common Council of the City of Janesville that the City
Manager be authorized to execute a Project Agreement with the Wisconsin Department of
Transportation and take any other action as may be necessary to implement and complete the
relocation and construction of said Highway 11 Janesville Bypass, West; and
BE IT FURTHER RESOLVED, that the City Manager and his designee(s), on behalf of the
City of Janesville, is/are hereby authorized and empowered to negotiate, draft, modify, review,
execute, and enter into additional agreements, payments, and record, file and/or make minor
modifications and/or amendments to any and all documents, papers, forms and agreements, and
to take whatever other actions as the City Manager may determine, from time to time and at any
time, necessary and/or desirable to effectuate the intent of this Resolution and/or project.
