2002-165ORDINANCE NO. 2002 - 165 An ordinance amending the City's No Smoking Ordinance so as to exempt restaurants whose sale of alcohol beverages accounts for 35% or more of the establishment's total gross receipts for the most recent calendar year, with a penalty for violations as set forth in JGO 8. 75.130. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 8.75.020 N. 1. of the Code of General Ordinances of the City of Janesville is hereby amended to read as follows: "1. Any "restaurant" whose sale of alcohol beverages accounts for 35% or more of the establishment's total gross receipts for the most recent calendar year (or for such period of time as otherwise determined elsewhere in this Chapter.)" SECTION II. Sections 8.75.070 A. 8.75.080 A. 8.75.080 A. 1. 8.75.080 A. 2. of the Code of General Ordinances of the City of Janesville are also hereby amended so that the "greater than 50%" formula and language are replaced with the "equal to or greater than 35%" amount. SECTION III. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
