An ordinance amending Chapter 8.64 Solid Waste and Recycling, Section
Directory; Subsection 11, Subsection Directory; Sections 8.64.100, 8.54.110,
8.64.120, and 8.64.150; Subsection 111, Sections 8.64.220, 8.64.210, and 8.64.220;
and Subsection V, Sections 8.64.500 and 8.64.540, with penalties for violations
thereof as set forth in the penalty and other relief provisions for Chapter 8.64.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
SECTION I. The below entries in Chapter 8.64 Section Directory of the Code of
General Ordinances of the City of Janesville is hereby, as applicable amended to read
as follows:

SECTION II. Sections 8.64.100, 8.64.110, 8.64.120 F., 8.64.120 G., and 8.64.150 H.
of the Code of General Ordinances of the City of Janesville are each hereby amended
to read, respectively, as follows:
8.64.100 Sanitary and Demolition Landfill and Yard Waste Composting
Sites.
The following provisions shall apply to all sanitary, demolition and other landfills
and yard waste composting sites within the City; owned, operated, contracted for
or regulated by the City.
8.64.110 Use — Required The area established, from time to time, by the
City Manager as the sanitary and demolition landfill depository (hereinafter
referred to as the "landfill "), and the yard waste composting sites shall be the only
area within the City in which solid waste may be deposited without express
permission of the Director of Public Works.
8.64.120 G. All other wastes and materials not specifically enumerated above
are prohibited from disposal, placement or deposit by any person at any time at,
upon or into any City sanitary or demolition landfill or any yard waste composting
sites.
8.64.120 F. The following, notwithstanding any of the above, shall be the only
wastes or materials accepted for disposal at any City yard waste composting
sites:
1. Grass clippings originating from properties within the City limits.
2. Leaves originating from properties within the City limits.
3. Garden waste, including all plants, fruits, and vegetables originating from
properties within the City limits.
4. Brush waste less than 1" in diameter and originating from properties within
the City limits.
8.64.150 E. For material hauled to a City Demolition Landfill, the fee charged
shall be five dollars and fifty cents ($5.50) per cubic yard if such debris originated
in the city and seven dollars ($7.00) per cubic yard if such debris originated
outside the city. These shall be the minimum fees regardless of the volume of

SECTION III. Section 8.64.220 D. of the Code of General Ordinances of the City of
Janesville is hereby created to read as follows:
8.64.220 D. All collection carts furnished by the City shall remain the property of
the City unless separately purchased from the City by an owner or tenant of a
property receiving collection service from the City. Such separately purchased
cart to remain the property of said owner or tenant.
SECTION IV. Various subsections in Section 8.64.500 [as set forth below] of the
Code of General Ordinances of the City of Janesville are hereby amended to read as
follows:

8.64.540 B. The basis for computation of the Fee is established under this
Subsection. The amount of the fee to be imposed, the establishment of formulas
for the calculation of charges, the creation of customer classifications for the
imposition of the fee, and changes in such charges, formulas, and customer
classifications shall be consistent with this Ordinance. The fee established

C. Charges shall be imposed to recover all or a portion of the costs of
the City's solid waste management programs. Such charges may include, but
are not limited to, the following components:
1. Collection Component. The collection component shall include the
estimated annual labor, equipment, contractual and administrative costs
associated with solid waste collection and transfer to a licensed solid
waste disposal or processing facility and as performed by employees of
the City of Janesville or its subcontractors. The Collection Component
shall be calculated by taking the sum of all Collection Component costs
and dividing that sum by the estimated number of billable customers.
2. Disposal, Processing and /or Marketing Component. The Disposal,
Processing and /or Marketing Component shall include the estimated cost
of disposing, processing and /or marketing all collected solid waste at a
licensed solid waste disposal or

SECTION V. Section 8.64.540 D. of the Code of General Ordinances of the City of
Janesville is hereby created to read as follows:
8.64.540 D. The computation of the solid waste management fee shall not
include any solid waste management activity for which a separate fee has been
established otherwise administratively or by Ordinance herein.
