An ordinance amending the City's No Smoking Ordinance so as to permit sliding service
windows between smoking and no-smoking rooms, with a penalty for violations as set forth in
JGO 8. 75.130.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
SECTION I. Section 8.75.060 A. of the Code of General Ordinances of the City of
Janesville is hereby amended to read as follows:
"8.75.060 Exemption for Separately Ventilated Areas. Notwithstanding any other
provision of this Chapter to the contrary, the following area(s) shall not be subject to the
smoking restrictions set forth in this Chapter:
A. A smoking room that is completely separated from the rest of the restaurant by
solid wall(s) or window(s) of rigid construction that run(s) from floor to ceiling with a separate
entrance(s) that has/have a separate solid door(s) that fully and effectively close(s) and that is/are
kept closed at all times and which room is separately ventilated from each and every other area
of the restaurant where smoking is prohibited. This section does not prohibit a service window
between a no-smoking room and a smoking room. The service window must have a sliding solid
window, made of glass, Plexiglas or other see-through material approved by building services,
not larger than 24" x 24", which window shall be kept fully closed except when food or
beverages are passed through."
SECTION II. This ordinance shall take effect immediately upon adoption by the Common
Council, the public health, welfare, peace, tranquility, good order, public benefit, and police
power so requiring.
