2002-134ORDINANCE NO. 2002-134 An ordinance to amend the text of the Title 12, Streets Sidewalks and Public Property and Title 18, Zoning to modify the standards for driveway openings for single family and two family residences. THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS FOLLOWS: SECTION I. Section 12.12.050 of the Code of General Ordinance is hereby amended to read as follows: 12.12.050 Curb opening- - Standards for approval. mo A person who owns land which abuts a public street has a right of access to such street, subject to the following restrictions: 1. Driveway openings shall be located at least forty feet from a block comer with the exception of single-family and two-family driveway openings which shall be located at least twenty-five feet from a block comer. a~,~*~,~,,,,~,e maximum driveway openings for single and two-family residences shall be no feet (24') at the sidewalk line and feet (30') at the curb. o o o o The building official may increase the maximum driveway opening to a width not greater than forty-~ feet (40 ~) at the ~urb to accommodate The maximum driveway opening for all uses other than single-family or two-family residences shall be thirty feet (30') at the sidewalk line and thirty-gve ~ feet (g-5' 36') a the curb, unless a greater opening is approved by the site plan review coordinator, and the City Engineer, and a permit for such greater opening is issued by the building inspector. Where a driveway is in joint use with an adjoining property, there shall be at least ten feet of driveway on each parcel. No permit shall be issued for a curb opening on undeveloped property until a building permit is applied for and, when required, a site plan is submitted and approved. To the extent possible, a curb opening shall be located so that vehicles approaching or using it will have adequate sight distance in both directions along the street. For any use which must be reviewed by the site plan review coordinator, no permit for a curb opening shall be issued until after such review has been completed and the location of the curb opening(s) are approved. The number of curb openings permitted serving a single property frontage along the street shall be the minimum deemed necessary by the building inspector and the city engineer or by the site plan review coordinator for reasonable service to the property without undue impairment of safety, convenience, and utility of the street. 9. A new curb opening, or any additional or enlarged curb opening, shall not be approved if it reduces the amount of the parking space in the area so as to create or increase parking problems, or if it impairs, endangers, inhibits, or impedes the safe and orderly flow of vehicular or pedestrian traffic. 10. Where property abuts more than one street, the building inspector and the city engineer or the site plan review coordinator may designate the street to which the property owner shall be entitled to access. Such designation of access to one street and prohibition of access to another street or streets is permitted if, in the opinion of the building inspector and City engineer or the site plan review coordinator, access to on or more of the abutting streets would interfere with the safe and orderly flow of vehicular or pedestrian traffic or cause a hazardous situation for movement in and out of the abutting property or for movement upon the street. Upon approval of the application for a permit for curb opening, such permit shall be issued by the building inspector. SECTION II. Section 18.36.020.A.9 of the Code of General Ordinance is hereby amended to read as follows: 18.36.020.A.9 Driveway Openings. Driveway openings shall be located at least forty feet from a block comer with the exception of single-family and two-family driveway openings which shall be located at least twenty-five feet (25') from a block comer. The maximum driveway opening shall be no than feet (24') at the sidewalk line and feet (30') at the curb. The building official may increase the maximum driveway opening to a width not greater than thirty-six feet (36') at the sidewalk line and fort~ feet (40' ~) at the curb to accommodate access to two-car garages for side-by- side two-family dwellings. Driveway openings shall be located at least forty feet (40') from a block comer with the exception of singe-family and two-family driveway openings which shall be located at least feet (25') from a block comer. The maximum driveway opening shall be thirty-fi,,~ feet (3~' 36') at the curb and thirty feet (30') at the sidewalk line. Where a driveway is in joint use with adjoining properties, there shall be at least ten feet of drive on each parcel. SECTION IV. Section 18.36.040 A. 8 and Section 18.36.050 A.5. are hereby amended to read as follows: 18.36.040 A. 8. and 18.36.050 A.5. Drive Openings. Driveway openings shall be located at least forty feet (40') from a block corner. The maximum driveway opening shall be thirty- Qve six feet (~3-5' 36') at the curb and thirty feet (30') at the sidewalk line. Where a driveway is in joint use with adjoining properties, there shall be at least ten feet of drive on each parcel. SECTION V. This ordinance shall take effect immediately upon adoption by the Common Council, the public health, welfare, peace, tranquility, good order, public benefit, and police power so requiring.
