2013-1019 CITY OF JANESVILLE
RESOLUTION NO. 2013-1019
A Resolution authorizing the City Manager to grant to Alliant Energy a Natural Gas
Easement crossing City property at 101 Centerway, located north of Centerway along
the western bank of the Rock River; and
WHEREAS, the easement encompasses an area approximately 12 feet in width by 22
feet in length which is approximately 264 square feet; and
WHEREAS, Alliant Energy intends to convey the existing 8" gas main attached to the
Centerway bridge to the City of Janesville for use as a carrier pipe for a future City
project extending fiber optics across the Rock River to interconnect multiple City
facilities; and
WHEREAS, the City Planning, Engineering, and Public Works staff have determined
that the locations of the proposed easement do not conflict with the current or planned
future use of the affected portion of the City property; and
WHEREAS, the Janesville City Council finds the granting of the proposed easement in
the desired location to be a reasonable request.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
Janesville that said Council hereby grants the easements to Alliant Energy as
described in Exhibit A attached hereto and made a part hereof:
BE IT FURTHER RESOLVED, that the City Manager and his designee(s) on behalf of
the City of Janesville, is /are hereby authorized and empowered to negotiate, draft,
modify, review, and execute this easement, and enter into additional agreements,
record, file and /or make minor modifications and /or amendments to any and all
documents, papers, forms, and agreements, and to make whatever other actions as the
City Manager may determine, from time to time and at any time, necessary and /or
desirable to effectuate the intent of this Resolution and /or project.

LEGAL DESCRIPTIONS FOR GAS LINE EASEMENT
Grantor's property being a strip of land lying adjacent to the Rock River which is part of Lot 26,
Water Power Subdivision and Government Lot 1, in the Northwest Quarter of Section 36, Town 3
North, Range 12 East, of the 4th P.M. in the City of Janesville, Rock County, Wisconsin, bounded
on the Northeast by the Westerly shore of the Rock River; on the Northwest by a line which is 40
feet Southeasterly from and parallel to the centerline of the most Easterly track of the Chicago
and Northwestern Railway Company; on the Southeast by the Southeasterly line of said Lot 26
and the North line of Centerway; and on the Southwest by a line described as commencing at the
most Westerly corner of said Lot 26; thence N42 °38'West along the Northeasterly line of N. River
Street, 46.84 feet; thence N20 °05'East along a line 40 feet Southeasterly from and parallel to the
centerline of the most Easterly track of said railroad, 166.50 feet to the point of beginning of the
Southwesterly boundary line. Said point lying S20 °05'W, 12.2 feet from a meander corner;
thence South 34 °28'30 "E, 197.19 feet to a point on the Southeasterly line of said Lot 26, said
point bearing N47 °20'30 "W, 12.0 feet from a meander corner on said Southeasterly line of Lot
26, and the point of termination of said Southwesterly boundary line; together with all adjacent
riparian rights.
Grantor's Quit Claim Deed being recorded January 5th, 1990, on Card 421, on Images 323-
324, as Document Number 1104848, in the office of the Register of Deeds for Rock County,
Wisconsin.
The easement being 20 feet wide and bounded and described as:
Commencing at the Northwest Corner of Lot 26 of Water Power Subdivision, thence
N46 °48'31 "E, 6.12 feet; thence N43 °43'16W, 47.93 fe et; thence N34 °42'58 "E, 144.08 feet to the
Point of Beginning for this description; thence N34 °42'58 "E, 11.11 feet; thence S36 °07'33 "E,
21.17 feet; thence S34 °42'58 "W, 11.32 feet; thence N35 °35'47' W, 21.24 feet to the Point of
Beginning. The easement being located within Government Lot 1, in the Northwest Quarter of
Section 36, Town 3 North, Range 12 East, of the 4th P.M. in the City of Janesville, Rock County,
Wisconsin.
A temporary construction easement being 15 feet wide and lying adjacent to and
southeasterly of the above described easement.
ALSO; a temporary construction easement being 15 feet wide and lying adjacent to and
northwesterly of the above described easement.
