2002-256REVISED RESOLUTION NO. 2002-256 A Resolution Granting Perpetual Easements for Off-Premise Signs on City Property to Arthur T. Donaldson. WHEREAS, the City Council has approved a TIF Development Agreement with the Ryan Companies for the construction of a warehouse distribution center for Deere & Company near the intersection of State Highway 351 and Beloit Avenue; and WHEREAS, said TIF Development Agreement requires the City to relocate the three westernmost off- premise signs located along the State Highway 351 frontage of the Deere & Company project site; and WHEREAS, on February 18, 2002, the Plan Commission approved the relocation of the off-premise signs to new locations on three city-owned properties; one located on State Highway 351 east of Beloit Avenue, one located on State Highway 11 east of Wright Road and one located on USH 14 south of Ruger Avenue; and WHEREAS, in order to facilitate the relocations of these off-premise signs, granting of perpetual sign easements to Arthur T. Donaldson, the owner of the existing sign easements, by the City Council for the three signs at the new City-owned locations is necessary; and WHEREAS, each of these easements grant Arthur T. Donaldson similar rights he currently enjoys at the present location such as the perpetual right to constmct, maintain and have access to a 12 foot by 50 foot back-to-back, double faced sign stmcture with a height of 30 feet on each of the three locations; and WHEREAS, upon relocation of the three off-premises signs from their current location along STH 351, west of Beloit Avenue, Arthur T. Donaldson will relinquish the current perpetual sign easements; and WHEREAS, the City Council finds the granting of the perpetual sign easements consistent with the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby grants perpetual easements to Arthur T. Donaldson at the following described locations: Easement A - State Highway 351 east of Beloit Avenue. Located in the SWl/4 of the NWl/4 of Section 18, T-2-N, R-13-E, of the 4th P.M. Town of LaPrairie, City of Janesville, Rock County, WI, described as follows: Commencing at the SE comer of Lot 1 of Certified Survey Map #1426440, recorded at the Rock County Register of Deeds; thence westerly along the south line of said Lot 1, 114 ft. to the Point of Beginning; thence continuing westerly along said south line of Lot 1, 50 ft; thence northerly, perpendicular to said south line of Lot 1, 110 ft; thence easterly, parallel with said south line of said Lot 1, 50 it; thence southerly, perpendicular to said south line of Lot 1, 114 ft. to the Point of Beginning. Easement B - State Highway 11 east of Wright Road. Located in the SE1/4 of the S W1/4 of Section 33, T-3-N, R-13-E, of the 4th P.M. Town of Harmony, City of Janesville, Rock County, WI, described as follows: REVISED RESOLUTION No. 2002-256 PAGE 2 Beginning at the intersection of the North R/W line of S.T.H.11 and the East line of Lot 2 of Certified Survey Map #1249732, recorded at the Rock County Register of Deeds; thence northerly and parallel with said East line of Lot 2, 110 ft; thence westerly and parallel with said North R/W line, 50 ft; thence southerly and parallel with said East line of Lot 2, 110 fi. to the said North R/W line; thence easterly along the said North R/W line 50 ft. to the Point of Beginning. The North R/W line of S.T.H. 11 is as shown on the State Highway Plans for State Project #1704-01-21. Easement C - USH 14 south of Ruger Avenue. Located in the NE1/4 of the SE1/4 of Section 33, T-3-N, R-13-E, of the 4th P.M. Town of Harmony, City of Janesville, Rock County, WI, described as follows: Commencing at the intersection of the West R/W line of U.S.H. 14 and the E-W Centerline of Section 33- 3-13; thence southerly along said West R/W line 600 ft. to the Point of Beginning; thence continuing along said West RJW line 50 ft; thence westerly, perpendicular to said West R/W line, 110 ft; thence northerly, parallel with said West R/W line, 50 ft; thence easterly, perpendicular to the said West R/W line, 110 ft. to the Point of Beginning. The West R/W line of U.S.H. 14 is as shown on the State Highway Plans for State Project #1704-01-21. BE IT FURTHER RESOLVED that the City Manager and the City Clerk of the City of Janesville are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of Janesville, proposed easements between the City and Arthur T. Donaldson, prepare and file such other documents, forms and papers pertaining to this transactions as may, from time to time, be necessary or desirable to effectuate the intent of this resolution and/or easements.
