2002-239RESOLUTION NO. 2002-239 A resolution granting electric transmission line easements extending across public lands adjoining USH 14 to Wisconsin Power & Light Company (YVP&L) and the American Transmission Company (ATC). WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of property located in the Northwest Quarter (NW 1/4) of Section 21, the Northeast Quarter (NE 1/4) of Section 20, and the Southeast Quarter (SE 1/4) of Section 33 of T.3N., R. 13E. in the 4th P.M., City of Janesville, Rock County, Wisconsin; WHEREAS, Wisconsin Power & Light and the American Transmission Company have requested that the City grant them the requested easements to facilitate the installation of a major overhead electric transmission line upgrade including replacement poles and higher voltage transmission lines on property owned by the City and adjoining various sections of USH 14; and WHEREAS, the City Planning, Engineering, Leisure Services and Public Works staff have determined that the location of the proposed easements do not conflict with the current or planned future use of city-owned lands in the easement areas; and WHEREAS, American Transmission Company has submitted an offer to provide financial compensation to the City for the granting of the easements in the amount of $78,040.00; and WHEREAS, this compensation shall be placed into the City bicycle and pedestrian trail construction account and expended for those purposes; and WHEREAS, the Janesville Plan Commission, pursuant to Section 62.23, Wisconsin Statutes, reviewed the granting of these easements to Wisconsin Power & Light/American Transmission Company and found it to be consistent with City plans but did not review the financial aspects of the transaction; and WHEREAS, providing these easements are in the best interest of the City and its residents; and NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE that the City of Janesville hereby grants the following described easements all located in T.3N., R. 13E. of the 4th P.M., City of Janesville, Rock County, Wisconsin, to Wisconsin Power & Light and American Transmission Company: Easement Area 1: A strip of land 35 feet in width and approximately 152 feet in length lying parallel with, adjacent to and south of the Southwesterly right-of-way line of U.S. Highway 14, as it now exists, in the Northeast Quarter of the Northwest Quarter of Section 21. Easement Area 2: A strip of land 30 feet in width and approximately 109 feet in length lying parallel with, adjacent to and south of the Southwesterly right-of-way line of U.S. Highway 14, as it now exists, in the Northeast Quarter of the Northeast Quarter of Section 20. Easement Area 3: A strip of land 40 feet wide and 2600 feet in length, being a part of Grantor's property described as: The easterly 40 feet of the Grantor's property, adjacent to, contiguous and westerly of the west right-of-way margin for U.S. Highway 14, as said Highway now exists; commencing at a point 328.5 feet north of the intersection of the East & West Quarter Line of Section 33, T.3N., R. 13E., City of Janesville, Rock County, Wisconsin, and said west right-of-way margin for U.S. Highway 14; thence south 2600 feet to a point, to be known as "Point A" and there RESOLUTION NO. 2002-239 PAGE 2 terminating; and also a strip of land 80 feet wide and 343 feet, mom or less, in length, located in the Southeast Comer of the Grantor's property and being 40 feet wide each side of the following described centerline, to wit: Starting from said "Point A"; thence S38°19'12"W. a distance of 343 feet, more or less, to a point where this reference line intersects the northerly right-of-way margin for State Highway 1 I, said northerly right-of-way margin also being the South Line of the Grantor's property, and them terminating. BE IT FURTHER RESOLVED that the City Manager and City Clerk of the City of Janesville are hereby authorized to negotiate, draft, enter into and execute, on behalf of the City of Janesville, a proposed easement between the City and Wisconsin Power & Light Company/American Transmission Company, prepare and file such other documents, forms and papers pertaining to this transaction as may, from time to time, be necessary or desirable to effectuate the intent of this resolution and/or easements; and AND BE IT FURTHER RESOLVED that the compensation shall be placed into the bicycle and pedestrian trial construction account and expended for those purposes.
