2002-221 RESOLUTION NO. 2002-221
A resolution granting a 16.5 foot wide underground utility easement extending across a portion of
Optimist Park adjoining Ruger Avenue to Ameritech.
WHEREAS, the City of Janesville, Rock County, Wisconsin, is the owner of property within Optimist
Park located in part of the Northeast Quarter (NE 1/4 ) of Section 33, Town 3 North, Range 13 East in the
4th P.M., City of Janesville, Rock County, Wisconsin;
WItEREAS, Ameritech has requested that the City grant them an underground utility easement, 16.5 feet
in width, extending across a portion of Optimist Park adjoining Ruger Avenue to facilitate an
underground communications transmission cable; and
WltEREAS, on January 7, 2002 the Janesville Plan Commission reviewed the granting of this easement
to Ameritech and found it to be consistent with City plans and practices plans provided that Ameritech
remove and relocate, at their cost, underground utilities within the easement if those facilities are deemed
to conflict with any future public improvement installations within this area; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF
JANESVILLE that the City of Janesville hereby grants the following described easement for an
underground communications transmission cable:
Part of the NE 1/4 of Section 33, T.3N., R. 13E. of the 4th P.M. in the City of Janesville, Rock County,
Wisconsin.
Said easement lying adjacent and parallel to the north right-of-way line of Ruger Avenue described as
follows: Beginning at the N.E. fight-of-way comer of North Wuthering Hills Drive and Ruger Avenue;
Thence S.78°04'40"E., 530.00 feet; Thence S.64°01'35"E., 841.27 feet to the West line of Lot 1 of the
Oakland Valley Subdivision (A platted subdivision in the City of Janesville), also being the East line of
the W. 1/2 of the NE.l/4; Thence N.00°48'35"E., along said West line 18.23 feet; Thence N.64°01'3Y'W.,
833.52 feet; Thence N.78°04'40"W., 535.51 feet to the East right-of-way line of North Wuthering Hills
Drive; thence S.00°01'10"W., 16.86 feet back to the point of beginning.
NOW, IHEREFORE, BE IT RESOLVED that the City Manager and City Clerk of the City of
Janesville are hereby author/zed to execute and deliver the proper easement to Ameritech stipulating the
utility removal and relocation requirement.
