A resolution releasing a utility easement which runs east and west through the parking lot
of the Creston Park Mall property located along Milton Avenue.
WHEREAS, an eight (8) foot wide utility easement was dedicated within the Siron's
Subdivision to the City of Janesville as recorded on May 4, 1938 in Volume 12, Page 15 of Plats,
as Document Number 405493 in the office of the Register of Deeds for Rock County,
Wisconsin.
WHEREAS, said utility easement has riot been used for municipal facilities and is no longer
needed for utility purposes; and,
WHEREAS, the City Council finds that the release of said utility easement will not be contrary
to the public interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE
CITY OF JANESVILLE that said utility easement as described below shall be released:
Located in the SW 1/4 of the SW 1/4 of Section 19, T.3N., R. 13E. of the 4th
P.M., City of Janesville, Rock County, Wisconsin described as follows:
The eight (8) foot public utility easement extending east and west through the center of
the blocks containing Lots 22 through 40 and specifically located between Lot 40 and
Randall Avenue of Siron's Subdivision to the City of Janesville as recorded in Volume
12, Page 15 of Plats of Rock County, Wisconsin.
BE IT FURTHER RESOLVED that said easement release by the City of Janesville does not
relinquish any inherent rights that other utility companies serving the area may have to use said
easement.
BE IT FURTHER RESOLVED that upon on adoption of this resolution, the City Clerk is
directed to record a certified copy of this resolution with the Register of Deeds of Rock County,
Wisconsin, thus granting the easement release as herein described.
