2013-975 RESOLUTION NO. 2013-975
A resolution releasing a utility easement on property located at 3333 Milton Avenue.
WHEREAS, a 10 -foot wide utility easement was dedicated on Certified Survey Map Document No.
808653 as recorded in Volume 3, Pages 260 and 261 of Certified Survey Maps of Rock County,
Wisconsin; and
WHEREAS, the owner of said property requests that the City release its rights to the existing easement;
and
WHEREAS, there are no existing public utilities within said easement; and
WHEREAS, the City Council finds the release of the existing easement consistent with the public
interest.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JANESVILLE
that the City of Janesville hereby releases all rights to the following described easement:
Located in NE % of the SE 1/4 of Section 18, T.3N., R.13E. of the 4 P.M. City of Janesville, Rock County,
Wisconsin, described as follows:
The northwest 10 feet of Lot 1 of a Certified Survey Map recorded in Volume 3, Pages 260 and 261 of
Certified Survey Maps of Rock County, Wisconsin as Document No. 808653 and being located in the NE
1/4 of the SE 1 /4 of Section 18, T.3N., R.13E. of the 4 P.M., City of Janesville, Rock County, Wisconsin.
Except the southwest 10 feet thereof.
BE IT FURTHER RESOLVED that said easement released by the City of Janesville does not relinquish
any inherent rights that other utility companies serving the area may have to use said easement.
BE IT FURTHER RESOLVED that upon adoption of this resolution, the City Clerk is directed to record a
certified copy of this resolution with the Register of Deeds of Rock County, Wisconsin, thus granting the
easement release as herein described.
