An ordinance prohibiting a person from knowingly resisting or obstructing an officer
while such officer is doing any act in an official capacity and with lawful authority, with a
penalty of not less than $50.00 nor more than $1, O00. OO for each violation, together with the
costs of prosecution, and relief for non-payment thereof as provided by law.
THE COMMON COUNCIL OF THE CITY OF JANESVILLE DO ORDAIN AS
FOLLOWS:
SECTION I. Chapter 9.08 of the Code of General Ordinances of the City of Janesville
is hereby created to read as follows:

Definitions.
Violation - Penalties
9.08.010 Generally. No person shall knowingly resist or obstruct an officer while such
officer is doing any act in an official capacity and with lawful authority.
9.08.020 Definitions.
In this Chapter:
A. "Officer" means a peace officer or other public officer or public employee having
the authority by virtue of the officer's or employee's office or employment to take another into
custody.
B. "Obstructs" includes without limitation knowingly giving false information to the
officer or knowingly placing physical evidence with intent to mislead the officer in the
performance of his or her duty including the service of any summons or civil process.
9.08.030 Violation -- Penalties.
A. Any person who violates any provision set forth in this chapter shall forfeit and
pay to the City a forfeiture of not less than $50.00 and no more than $1,000.00.
B. To each such forfeiture the Court shall add and impose against the violator all
customary court costs, fees, penalties, and assessments.

C. Upon default in payment of an imposed forfeiture and costs, such convicted
person may be imprisoned for not more than sixty (60) days in the Rock County Jail and/or the
court may impose other penalties and remedies as otherwise provided by law.

946.41 as from time to time amended or renumbered."
