Minutes 05-13-02.docPROCEEDINGS OF THE CITY COUNCIL CITY OF JANESVILLE, WISCONSIN REGULAR MEETING May 13, 2002 Approved May 28, 2002 VOL. 53 NO. 3 Regular meeting of the City Council of the City of Janesville held in the Municipal Building on May 13, 2002. The meeting was called to order by Council President DeGarmo at 7:00 p.m. Councilmember Williams led the Council in the Pledge of Allegiance. Present: Council President DeGarmo, Councilmembers Steeber, Murphy, Damron, Williams, Brien and O'Leary. CONSENT AGENDA Councilmember O'Leary stepped down from the Council table. Minutes of the regular meeting of April 22, 2002. Licenses; and Recommendations of the Alcohol License Advisory Committee. Action on a motion to approve final Certified Survey Map #02015-C, 1 lot on Rockport Park Drive in Rock Township. Action on a motion to approve final Certified Survey Map #02021-C,1 lot on Capital Circle. Authorization for the Administration to deny a liability claim for Jean M. Thompson, Jillian B. Thompson and Gretta M. Thompson in the amount of $750,000.00. Council President DeGarmo removed three items, Local 95 UAW, Tremers, Inc., and Milton Avenue Beverage, from the license agenda and stated that the remainder of the Consent Agenda would be approved if there were no objections. There were no objections. Attorney Harry C. O'Leary asked Council to reconsider the ALAC's recommendation to deny a drive up window for Milton Avenue Beverage. Councilmember Murphy moved to grant Milton Avenue Beverage a Class A combination license and allow a drive-up window, seconded by Councilmember Steeber and passed with the following vote: Aye: Councilmembers Steeber, Murphy, Damron, and DeGarmo. Nay: Councilmembers Williams and Brien. Absent: Councilmember O'Leary. Councilmember Brien stated he would abstain from voting on the license renewal for Local 95 UAW due to a conflict. Councilmember Williams moved to grant a Class B license to Local 95 UAW, seconded by Councilmember Murphy and passed with the following vote: Aye: Councilmembers Steeber, Murphy, Damron, William and DeGarmo. Pass: Councilmember Brien. Absent: Councilmember O'Leary. Councilmember O'Leary returned to the Council table. Attorney Mark Schultz, representing Ed Quaerna, addressed Council regarding Tremer's license application. Jim Quaerna, 235 North Palm Street, stated he was rescinding his relinquishment for Tremors Bar & Grill. Councilmember Murphy moved to table the Tremer's Inc./Tremors Bar & Grill applications for two weeks to allow the private parties to work the matter out, seconded by Councilmember Brien and passed unanimously. A proposed resolution recognizing the week of May 12th as "National Police Week" and the day of May 15th as "Peace Officers' Memorial Day". Councilmember Williams moved to adopt said resolution, seconded by Councilmember Brien and passed unanimously. (File Res. No. 2002-255) A proposed resolution in commendation of Janice A. Felda's service to the City of Janesville. Councilmember Williams moved to adopt said resolution, seconded by Councilmember Steeber and passed unanimously. (File Res. No. 2002-249) A proposed resolution in commendation of Thomas J. Hill's service to the City of Janesville. Councilmember Williams moved to adopt said resolution, seconded by Councilmember Steeber and passed unanimously. (File Res. No. 2002-250) OLD BUSINESS 1. Requests and comments from the public on matters which can be affected by Council action. Ty Bollerud, 424 South Pearl Street, urged Council to remove the fences at Lion's Beach and volunteered to do so. Richard Frank, 1119 Elida Street, encouraged Council to work on peripheral streets. Council President DeGarmo combined action on items 2 & 3. 2-3. Proposed ordinances annexing (Ord. 2002-126) and zoning (Ord. 2002-127) property located south of and adjoining Rockport Park Drive received their second reading and public hearing. No one appeared for the hearing. Councilmember Brien moved to adopt said ordinances, seconded by Councilmember Steeber and passed unanimously. (File Ord. Nos. 2002-126 & 2002-127) NEW BUSINESS 1. Recommendation of the Plan Commission: a proposed resolution approving the final plat of Apple Ridge Second Addition. Councilmember O'Leary moved to adopt said resolution, seconded by Councilmember Steeber and passed unanimously. (File Res. No. 2002-254) 2. A proposed resolution authorizing easements for off-premise signs on City property. Councilmember Steeber moved to adopt said resolution, seconded by Councilmember Murphy and passed unanimously. (File Res. No. 2002-256) 3. Council review of Waterfowl Management Strategy Plan. Council reviewed the options presented in the Waterfowl Management Plan. Council President DeGarmo moved to develop a hunting implementation plan to manage the goose population, with Council to approve the final plan, seconded by Councilmember Steeber and passed with the following vote: Aye: Councilmembers Steeber, Murphy, Damron, DeGarmo, Brien and O'Leary. Nay: Councilmember Williams. 4. Council review of Aquatic Services Levels. Council reviewed the Administration's recommendations. Councilmember O'Leary moved to close Riverside wading pool for the 2002 season, seconded by Councilmember Murphy and passed unanimously. 5. A proposed ordinance updating the procedure for the application, review and issuance of provisional and regular alcohol operator (bartender) licenses was introduced and scheduled for public hearing on May 28, 2002. (File Ord. No. 2002-128) 6. A proposed ordinance prohibiting the restriction or obstruction of a law enforcement officer engaged in the official discharge of his/her duties was introduced and scheduled for public hearing on May 28, 2002. (File Ord. No. 2002-129) 7. A proposed ordinance to amend the City of Janesville's worthless checks ordinance to include worthless checks issued in the amounts between $1,000.00 and $2,500.00 was introduced and scheduled for public hearing on May 28, 2002. (File Ord. No. 2002-130) 8. Matters not on the Agenda. There were none. 9. Closed session. Councilmember Steeber moved to convene into closed session pursuant to Wisconsin State Section 19.85 (1) (g), for the purpose of conferring with legal counsel for the governmental body who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is likely to become involved concerning one or more personal injury and/or property damage claims, seconded by Councilmember Williams and passed unanimously.
