Authorizing the City Manager to enter into a contract with A.M. Disposal, Inc., providing long-
term pricing for the disposal of solid waste at the Rock County/City of Janesville sanitary
landfill.
WHEREAS, A.M. Disposal, Inc. has requested permission from the City of Janesville to deposit
lawful materials originating outside Rock County into the City's sanitary landfill; and,
WHEREAS, the additional tonnage to be disposed by A.M. Disposal, Inc. is beneficial to the
City in the form of additional revenue and in maintaining low disposal rates for all landfill users;
and
WHEREAS, Janesville General Ordinance Section 8.64.150 (K) permits such long term disposal
contracts; and,
WHEREAS, the Common Council find this contract to be of benefit to the City and in the best
interest of the City's landfills and the City overall.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Janesville that
the City Administration, on behalf of the City of Janesville, is hereby authorized to jointly and
severally enter into a contract with A.M. Disposal, Inc. and to negotiate, draft, enter into, an~end
such contracts and/or other agreements and modifications, and to take such other actions as the
City Manager may determine, from time to time, to be in the best interest of the City to
effectuate the purpose of this resolution and/or administration of said contracts, and to establish
the time frames and other terms and conditions of each contract not expressly addressed by this
resolution, as well as to include the terms and conditions set forth herein.
BE IT FURTHER RESOLVED by the Common Council that the City of Janesville hereby offers
the following disposal pricing terms to A.M. Disposal, Inc.:
Price paid will be the lesser of the fees established by City Ordinance or the fees
administratively negotiated and established by contract;
Price paid in 2002 will be $19.70 per ton;
Beginning in 2003, and through the operating life of the City's currently operating
sanitary landfill, the City reserves the right to annually increase fees three percent
(3%);
Increases in the Wisconsin Department of Natural Resources Environmental Fees,
Recycling surcharge, and any other fees, taxes, or surcharges as provided in Statutes
and Wisconsin Administrative Code, as from time to time revised, amended or
renumbered, shall be paid directly by A.M. Disposal, Inc. and shall not be included in
the calculation of any potential annual rate increase.
